similar vein, the Irish Council for Civil Liberties asserted that secti<strong>on</strong> 24 might “impinge up<strong>on</strong> the<br />

c<strong>on</strong>stituti<strong>on</strong>al duty of judges to ensure that sentences are proporti<strong>on</strong>ate to both the gravity of the crime<br />

and the pers<strong>on</strong>al circumstances of the offender.” 509 The <strong>Law</strong> Society 510 and some prominent criminal law<br />

practiti<strong>on</strong>ers were also quick to voice their c<strong>on</strong>cerns regarding proporti<strong>on</strong>ality and the separati<strong>on</strong> of<br />

powers. 511 Having c<strong>on</strong>sulted the Council of State, the President decided not to refer the Bill to the<br />

Supreme Court and signed the Bill into law. 512<br />

2.214 <strong>Mandatory</strong> sentences for repeat offenders have been c<strong>on</strong>sidered in a number of recent decisi<strong>on</strong>s.<br />

In The People (DPP) v McMah<strong>on</strong>, 513 the Court of Criminal Appeal c<strong>on</strong>sidered an appeal by the DPP<br />

against the leniency of a 10-year sentence. The resp<strong>on</strong>dent, a psychiatric patient who had stabbed a<br />

doctor, had been c<strong>on</strong>victed of assault causing serious harm, c<strong>on</strong>trary to secti<strong>on</strong> 4 of the N<strong>on</strong> Fatal<br />

Offences Against the Pers<strong>on</strong> Act 1997, an offence which carries a maximum life sentence. The<br />

resp<strong>on</strong>dent had a previous c<strong>on</strong>victi<strong>on</strong> for manslaughter for which he had been sentenced to 10 years’<br />

impris<strong>on</strong>ment, which had been reduced to 7 years <strong>on</strong> appeal. The resp<strong>on</strong>dent had been released<br />

approximately 8 m<strong>on</strong>ths before committing the secti<strong>on</strong> 4 offence. The DPP argued that the maximum<br />

sentence of life impris<strong>on</strong>ment should have been imposed as the resp<strong>on</strong>dent presented a clear danger to<br />

others.<br />

2.215 The Court of Criminal Appeal indicated that the case raised an important issue, namely, whether<br />

sentencing courts were obliged to impose the maximum life sentence where there was evidence that the<br />
