that notification, the facility operator must provide either (1) an indication that the facility<br />
operator in the proposed excavation site does not have any subsurface installations that<br />
may be affected by the excavation, (2) an indication that the area of excavation could be<br />
affected, (3) an indication that the facility operator’s records of the subsurface<br />
installations are publicly available to the excavator, or (4) a representative to locate and<br />
field mark in accordance with the American <strong>Public</strong> Works Association Color Code the<br />
approximate location of the subsurface installation. The facility operator promptly<br />
notifies the Hawaii One Call Center that the facility operator has fulfilled at least one of<br />
the four requirements, and the Hawaii One Call Center promptly provides notice to<br />
excavators that the facility operators have complied.<br />
In November 2005, the <strong>Commission</strong> selected and contracted with One Call<br />
Concepts, Inc. (“One Call Concepts”) as the exclusive provider for the administration<br />
and operation of the Hawaii One Call Center, commencing December 1, 2005 through<br />
June 30, 2009. One Call Concepts provides one call services for one call centers in<br />
Minnesota, Kansas, Louisiana, Missouri, Oregon and Washington and has been<br />
providing one call center services since its formation in 1982. In January 2006,<br />
pursuant to HRS Chapter 269E, the <strong>Commission</strong>, through One Call Concepts, began<br />
operations of the One Call Center. On May 26, 2009, Governor Linda Lingle signed<br />
House Bill (“H.B.”) No. 1059, H.D.2, S.D.1 into law as Act 72, which changed the status<br />
of the State One Call Center program from a pilot program to a permanent program.<br />
Shortly thereafter, the <strong>Commission</strong> entered into a formal extension of the<br />
One Call Concepts, Inc., contract for operation of the One Call Center through June 30,<br />
<strong>2011</strong>. On January 19, <strong>2011</strong>, the <strong>Commission</strong> issued a Request for Proposal (“RFP”) to<br />
contract for the future operation of the Hawaii One Call Center. On April 20, <strong>2011</strong>,<br />
One Call Concepts was awarded as the exclusive provider for the administration and<br />
operation of the Hawaii One Call Center from July 1, <strong>2011</strong> to June 30, 2014.<br />
The Committee was established by the <strong>Commission</strong> under Chapter 269E, HRS<br />
to advise the <strong>Commission</strong> in implementing the One Call Center. The Committee<br />
consists of 18 members appointed by the <strong>Commission</strong> from various sectors of the utility<br />
industry and government. In the FY 20<strong>12</strong>, the Advisory Committee held quarterly<br />
meetings to deliberate on a variety of issues regarding the One Call Center. In<br />
November <strong>2011</strong> and May 20<strong>12</strong>, the One Call Concepts held training seminars on Oahu,<br />
Maui, Kauai and the Island of Hawaii. The training seminars educated participants in<br />
the many facets of the One Call Center law including notification of excavation, marking<br />
of excavation sites, identification of subsurface installations by operator, excavation<br />
procedures and more. There were approximately 200 participants who attended the<br />
training seminars.<br />
On January 23, 20<strong>12</strong>, Governor Neil Abercrombie approved Chapter 83, Hawaii<br />
Administrative Rules entitled "Hawaii One Call Center Subsurface Installation Damage<br />
Prevention Program." Under the authority of the One Call Center law and the Hawaii<br />
One Call Center Subsurface Installation Damage Prevention Program administrative<br />
rules, the <strong>Commission</strong> is currently creating the “One Call Enforcement and Compliance<br />
Program” to ensure excavators and operators properly comply with Hawaii’s One Call<br />
laws and rules.<br />
On June 29, 20<strong>12</strong>, Governor Abercrombie adopted Act 196, SLH 20<strong>12</strong>, which<br />
exempts the excavation activities of pest control operators from Chapter 269E, HRS,
