IX. OBLIGATIONS OF THE CONTRACTOR
A. DELIVERY
7. Supplier shall deliver at his own expense the awarded items at the
aforementioned NFA installations within thirty (30) calendar days upon
receipt of the Notice to Proceed. Delivery shall be covered by a Charge
Invoice and Delivery Receipt.
8. Shall undertake the fitting/installation of the following rice mill parts:
abrasive rollers, screwed iron roller, pawl, iron roller, perforated steel
plates and perforated steel screens, to ascertain conformity to
specifications.
9. Shall personally or through his authorized representative, witness the
inspection/physical verification to be conducted by the inspection team.
10. Shall replace all rejected items within ten (10) calendar days from receipt
of the Notice of Rejection and that said rejected items shall remain with
NFA to be withdrawn only upon delivery and acceptance of the
replacement.
11. Failure to deliver and fit/install the materials on the specified period for
any cause not attributable to NFA shall make the supplier liable to
liquidated damages as specified under Item X.
12. All expenses, losses and damages which may be incurred while the items
for delivery are in transit to the identified NFA installations shall be borne
by the supplier.
B. BILLING
Supplier shall bill NFA upon completion of the delivery of the bid quantity and
shall be paid within fifteen (15) working days after the complete submission of
the required documents.
X. LIABILITIES OF THE CONTRACTOR
A. LIQUIDATED DAMAGES
4. For failure to satisfactorily deliver the materials under the contract within the
delivery period as stated, inclusive of duly granted time extensions, if any, the
supplier shall be liable for damages for the delay and shall pay the NFA
liquidated damages, not by way of penalty, an amount equal to 1/10 of 1% of
the cost of the delayed materials scheduled for delivery for every day of delay
until such materials are finally delivered and accepted by the NFA.
5. Such amount shall be deducted from any money due or which may become due
the supplier, or collected from any securities or warranties posted by the
