<strong>2009</strong>Annex – I:MEMORANDUM OF UNDERSTANDINGBETWEEN THE UNITED NATIONS DEVELOPMENT PROGRAMMEAND THE MINISTRY OF REGIONAL DEVELOPMENT AND CONSTRUCTION OF UKRAINE,This Memorandum of Understand<strong>in</strong>g (here<strong>in</strong>after referred to as MoU) has been signed between the United NationsDevelopment Programme (here<strong>in</strong>after referred to as “<strong>UNDP</strong>”) and the M<strong>in</strong>istry of Regional Development andConstruction of Ukra<strong>in</strong>e (here<strong>in</strong>after referred to as the “M<strong>in</strong>istry”). <strong>UNDP</strong> and M<strong>in</strong>istry are here<strong>in</strong>after collectivelyreferred to as the “Parties”:Whereas, the issues of susta<strong>in</strong>able development, decentralization, regional development and territorial reform arerelated with the Millennium Development Goals and the National Strategy of Ukra<strong>in</strong>ian Government on regionalpolicy and policy <strong>in</strong> the field of construction, architecture and city-plann<strong>in</strong>g ,Aim<strong>in</strong>g at ensur<strong>in</strong>g susta<strong>in</strong>able development of the territories of Ukra<strong>in</strong>e, at promot<strong>in</strong>g territorial reform,decentralization and good governance, and improv<strong>in</strong>g liv<strong>in</strong>g quality of the citizens,With regard to:· Agreement between UN and the Government of Ukra<strong>in</strong>e on the foundation of UN Representative Office ofOctober 6, 1992· Regulations “On the M<strong>in</strong>istry Of Regional Development And Construction Of Ukra<strong>in</strong>e” approved by theDecree of the Cab<strong>in</strong>et of M<strong>in</strong>isters of Ukra<strong>in</strong>e № 750 of 16 th may, 2007· “Concept of State Regional Policy” of 2008,· Programme of activities of the Cab<strong>in</strong>et of M<strong>in</strong>isters of Ukra<strong>in</strong>e “Ukra<strong>in</strong>ian Breakthrough: For People, NotPoliticians” of 2007,· The United Nations Millennium Declaration of September 8, 2000 and Ukra<strong>in</strong>e Millennium DevelopmentGoals (UMDG)· Johannesburg declaration and plan of activities of 2002· European Charter on Local Self-Governance of 1996· Country Programme Action Plan (CPAP) of UN of 2006· Local Development Programme, <strong>UNDP</strong> Ukra<strong>in</strong>e· Municipal Governance and Susta<strong>in</strong>able Development Programme (MGSDP) project document of 2007· Crimea Integration and Development Programme (CIDP) project document of 2007· Community Based Approach to Local Development project document of 2007Now, therefore, the Parties hereto have agreed to cooperate as follows:ArticleIPurposeThe purpose of this MoU is to promote susta<strong>in</strong>able development of the regions of Ukra<strong>in</strong>e, organizational,methodological and scientific support for strengthen<strong>in</strong>g decentralized development mechanism through local andregional self-governance, improvement of adm<strong>in</strong>istrative-territorial situation of Ukra<strong>in</strong>e and improvement of qualityof public services which are delivered to residents.ArticleIIMa<strong>in</strong> fields of cooperationThe Parties will develop co-operation <strong>in</strong> the follow<strong>in</strong>g spheres:(1) Build<strong>in</strong>g local and regional capacity for decentralized development and elaboration and dissem<strong>in</strong>ation ofthe best Practices <strong>in</strong> the area of susta<strong>in</strong>able regional development.The Parties <strong>in</strong> their collaboration and jo<strong>in</strong>t actions will pay attention and prioritize the follow<strong>in</strong>g directions:· Promot<strong>in</strong>g participatory governance and creat<strong>in</strong>g effective decentralization <strong>in</strong>stitutional system, which wouldallow local communities, regional authorities, small bus<strong>in</strong>esses, non-governmental organisations and academia andthe bodies of local self-governments to engage <strong>in</strong> transparent participatory plann<strong>in</strong>g process and resolve social,economic and environmental problems on their territories.· Improv<strong>in</strong>g policies/legislation to create enabl<strong>in</strong>g environment for territorial communities, local and regionalself-government bodies, non-governmental organizations to undertake bottom-up participatory plann<strong>in</strong>g andparticipate <strong>in</strong> the local and regional level susta<strong>in</strong>able development activities on the local level under the frameworkof public-private partnership.· Implementation of the state regional policy with consideration of the best European practices· Initiat<strong>in</strong>g jo<strong>in</strong>t scientific research <strong>in</strong> the field of regional development.32
