The EPA explains that it is “…concernedabout the negative impacts associated with locating additionalstructures on a site that is considered to be sacred to the NativeHawaiians.” The EPA suggests that the Final EIS should includemore information on stated topics and Memoranda of Agreement(MOA) for mitigation measures between NSF and the community.EPA suggests the NSF discuss and implement additional mitigationmeasures to address historical and cultural impacts, “The FEIS shoulddiscuss in detail all activities associated with compliance inconjunction with the NHPA. The FEIS should include informationabout the Section 106 process, consultations with the NativeHawaiians, and references to any MOA which might be implementedat a later date.” “EPA recommends that the FEIS describe suggestionsfrom Native Hawaiians and local community and the ways in whichthe agency will respond to these concerns. Resolution strategies andmitigation plans should be discussed in detail. Mitigation measurescould include funding for Hawaiian cultural education programs,improved cultural centers, and research on sacred sites within HO.”Concerning the topography “EPA recommends NSF consult withNative Hawaiian organizations and HALE [Haleakalā National Park]personnel concerning the reconstruction of the Pu‘u Kolekole cone.”Regarding the endangered U'au, “The NSF should work closely withbiologists at HALE and the US Fish and Wildlife Service to ensurethat the video surveillance does not adversely impact this endangeredspecies.” Regarding environmental justice, “The FEIS should includea more thorough and detailed analysis of impacts on the NativeHawaiians, a minority population.
