August 2009RIMYI5) The identity <strong>of</strong> <strong>the</strong> complainant in any case shall be made known to <strong>the</strong> member, unless <strong>the</strong>Investigations Panel determines that <strong>the</strong>re are compelling reasons why <strong>the</strong> complainant shouldnot be so identified, taking into account, inter alia, <strong>the</strong> need for <strong>the</strong> member to fully understand<strong>the</strong> case against him/her.6) If, having undertaken appropriate initial inquiries, <strong>the</strong> Investigations Panel decides that <strong>the</strong>re isno prima facie case for disciplinary action, it will inform <strong>the</strong> Chairman and <strong>the</strong> Secretary <strong>of</strong> <strong>the</strong>Executive Council and <strong>the</strong> Secretary will write to <strong>the</strong> complainant (where applicable) informinghim/her <strong>of</strong> its decision.7) The Secretary will also, at <strong>the</strong> same time (in cases where <strong>the</strong> member concerned was aware that<strong>the</strong> Investigations Panel was considering a matter relating to him/her) write to <strong>the</strong> memberadvising him/her <strong>of</strong> its decision.8) If, on <strong>the</strong> o<strong>the</strong>r hand, having undertaken appropriate initial enquiries, <strong>the</strong> Investigations Paneldecides that <strong>the</strong>re is a prima facie case for disciplinary action, it will propose a course(s) <strong>of</strong>disciplinary action, will inform <strong>the</strong> Chairman and <strong>the</strong> Secretary <strong>of</strong> <strong>the</strong> Executive Council and<strong>the</strong> Secretary will write to <strong>the</strong> member setting out <strong>the</strong> following:a) The conduct complained <strong>of</strong>;b) The fact that, having undertaken appropriate inquiries, <strong>the</strong> Investigations Panel has decidedthat <strong>the</strong>re is a prima facie case for disciplinary action;c) Identifying <strong>the</strong> relevant ground(s) for disciplinary action in accordance with paragraph 2above;d) Proposing one or more courses <strong>of</strong> disciplinary action as set out at paragraph 9 below;e) Inviting <strong>the</strong> member to reply, in writing, within 21 days from <strong>the</strong> date <strong>of</strong> <strong>the</strong> letter indicatingwhe<strong>the</strong>r or not he/she consents to <strong>the</strong> proposed course(s) <strong>of</strong> disciplinary action;f) Advising <strong>the</strong> member that if he/she does not consent to <strong>the</strong> proposed course(s) <strong>of</strong>disciplinary action, <strong>the</strong> matter will be referred to <strong>the</strong> Disciplinary Tribunal;g) Inviting <strong>the</strong> member (if he/she does not consent to <strong>the</strong> proposed course(s) <strong>of</strong> disciplinaryaction) to enclose with his/her response his/her written representations, indicating if he/shewould prefer <strong>the</strong> matter to be dealt with on paper or at a hearing.h) Advising <strong>the</strong> member that if he/she does not respond within <strong>the</strong> time permitted <strong>the</strong>Investigations Panel's proposal will stand as <strong>the</strong> decision <strong>of</strong> <strong>the</strong> <strong>Association</strong>.Disciplinary Action9) Any one or more <strong>of</strong> <strong>the</strong> following courses <strong>of</strong> disciplinary action may be proposed by <strong>the</strong>Investigations Panel (or ordered by <strong>the</strong> Disciplinary Tribunal in accordance with paragraph 24below) as is considered appropriate having regard to <strong>the</strong> nature and seriousness <strong>of</strong> <strong>the</strong> matter,35
