August 2009RIMYI<strong>the</strong> member's character and past record and to any o<strong>the</strong>r circumstances considered to berelevant:a) That a written warning or reprimand be given;b) That <strong>the</strong> member be required to give a written undertaking to refrain from continuing orrepeating <strong>the</strong> conduct in question;c) That membership be suspended for such period as is considered appropriate, membership tobe automatically restored at <strong>the</strong> end <strong>of</strong> such period: andd) Expulsion from membership for such period as is considered appropriate, <strong>the</strong> expelledmember being able to re-apply for membership at <strong>the</strong> end <strong>of</strong> such period.In <strong>the</strong> case <strong>of</strong> (c) and (d) above, any teaching certificates in force must also be withdrawn for<strong>the</strong> period <strong>of</strong> suspension/expulsion.10) Nei<strong>the</strong>r <strong>the</strong> member, nor <strong>the</strong> <strong>Association</strong>, may be ordered to pay <strong>the</strong> legal or o<strong>the</strong>r costs <strong>of</strong> <strong>the</strong>o<strong>the</strong>r party incurred in connection with <strong>the</strong>se disciplinary procedures.Member's Response11) If, within <strong>the</strong> time permitted, <strong>the</strong> member consents to <strong>the</strong> proposed disciplinary action, or ifhe/she does not respond within that time, <strong>the</strong> Investigations Panel's proposal shall stand as <strong>the</strong>decision <strong>of</strong> <strong>the</strong> <strong>Association</strong>Referral to Disciplinary Tribunal12) If. within <strong>the</strong> time permitted, <strong>the</strong> member refuses consent, <strong>the</strong> Chairman <strong>of</strong> <strong>the</strong> ExecutiveCouncil shall appoint a Disciplinary Tribunal to consider <strong>the</strong> matter ei<strong>the</strong>r on paper (ifrequested by <strong>the</strong> member) or at a hearing.Composition <strong>of</strong> <strong>the</strong> Disciplinary Tribunal13) The Disciplinary Tribunal shall consist <strong>of</strong> three persons as follows:-a) One independent person who is not, and who has never been, a member <strong>of</strong> <strong>the</strong> <strong>Association</strong>("<strong>the</strong> Independent Member").b) The Chairman <strong>of</strong> <strong>the</strong> Executive Council, or ano<strong>the</strong>r member <strong>of</strong> <strong>the</strong> Council appointed by <strong>the</strong>Chairman;c) One Moderator who was not on <strong>the</strong> Investigations Panel considering <strong>the</strong> matter;((b) and (c) toge<strong>the</strong>r being .'<strong>the</strong> Assistant Members")36
