<strong>MIL</strong>-<strong>HDBK</strong>-<strong>502</strong>: ACQUISITIONALOGISTICSWarranty ExamplesDESIGN/MANUFACTURING CONFORMANCE WARRANTY: Notwithst<strong>and</strong>ing government inspection <strong>and</strong>acceptance of warranted items, the contractor warrants that the supplies covered by the terms of this warranty shallconform to the design <strong>and</strong> manufacturing requirements in accordance with PDD-ARC210-001, the technical datapackage (TDP), <strong>and</strong> approved manuals for the warranty period defined in Part III. Product configuration may bealtered or upgraded for product improvements or st<strong>and</strong>ardization provided the changes do not impact form, fit, orfunction at the WRA level. The TDP shall be updated to reflect the resultant changes in accordance with the CDRLrequirements.MATERIAL AND WORKMANSHIP WARRANTY: Notwithst<strong>and</strong>ing government inspection <strong>and</strong> acceptance ofwarranted items, the contractor warrants that the supplies covered by the terms of this warranty are free fromdefects in material <strong>and</strong> workmanship that would cause a warranted item to fail to conform to the essentialperformance requirements for the warranty period defined in Part III.ESSENTIAL PERFORMANCE WARRANTY: For the warranty period in Part III, the contractor warrants theessential performance requirements of the warranted items. Should the warranted items not meet the MTBF, thecontractor shall furnish to the government temporary spares in accordance with Part V, subparagraph E. Thecontractor warrants all RT-1556/ARC <strong>and</strong> RT-1744/ARC units covered by this warranty for the hourly mean timebetween failure (MTBF) rates specified for the following time periods:Guaranteed Mean Time Between FailureMONTHS (*) 0-12 13-24 25-36 37-48 49-60MTBF HOURS 667 679 728 853 1100(*) Months after execution of the contract modification which includes this warranty.If during the warranty period, the Warranty Review Board (WRB) determines that the ratio of actual averagesystem operation hours to aircraft flight hours differs from the 1.4 “K” factor by 25% or more, the contractor <strong>and</strong>the government will negotiate an equitable adjustment to the K factor <strong>and</strong> the resulting MTBF calculation. If afterthe warranty expires, the WRB determines that the total annual operating time (TOH) as defined in Part Vsubparagraph D(5), herein, <strong>and</strong> as determined by NALDA data, differs from the following by 25% or more, thegovernment <strong>and</strong> contractor will negotiate an equitable adjustment in contract price:Total Annual Operating HoursMONTHS (*) 0-12 13-24 25-36 37-48 49-60TOH 238,395 459,073 668,734 755,730 811,213(*) Months after execution of the contract modification which includes this warranty.TURN AROUND TIME WARRANTY: The contractor warrants that all corrective action shall be completed withwarranted items ready for delivery to the government within an average turn around time of 30 calendar days fromthe date the contractor receives the warranted items at the contractor’s facility until the date of shipment from thecontractor’s facility in a ready for issue (RFI) condition. The contractor shall ship all processed RFI end items togovernment controlled storage in the absence of other shipping instructions from the procuring contracting officeror administrative contracting officer (PCO/ACO). If reusable containers are not available, the contractor shall shipend items using best commercial practices to assure safe delivery at destination.WARRANTY FOR CORRECTED OR REPLACED SUPPLIES: Any warranted item repaired or replacedpursuant to this warranty is subject to the provisions of this clause, in the same manner as warranted items initiallydelivered.Figure 6-2.
