General power of the Bar Council of India to makerules.— (1) The Bar Council of India may make rules fordischarging its functions under this Act, and, in particular,such rules may prescribe—(af) the minimum qualifications required foradmission to a course of degree in law in anyrecognised University;(ag) the class or category of persons entitled to beenrolled as advocates;(ah) the conditions subject to which an advocateshall have the right to practise and the circumstancesunder which a person shall be deemed to practise as anadvocate in a court;………………(d) the standards of legal education to be observedby Universities in India and the inspection ofUniversities for that purpose;(e) the foreign qualifications in law obtained bypersons other than citizens of India which shall berecognised for the purpose of admission as anadvocate under this Act;………”REPORT OF 3-MEMBER COMMITTEE ON REFORM OF LEGAL EDUCATION
Constitutional and Statutory Framework 8The Supreme Court, through its decision in the matter of Bar Council ofIndia vs. Board of Management, Dayanand College of Law, (2007) 2SCC 202, surveyed the statutory powers available to BCI under theprovisions of the Advocates Act, 1961 as well as the Rules framedthereunder, and concluded that since BCI was concerned with thestandards of the legal profession and the equipment of those who seekentry into that profession, BCI is, thus, also concerned with the legaleducation in the country.b) The University Grants CommissionAs identified by the Supreme Court in the matter of Prem Chand Jain vs.R.K. Chabbra, (1984) 2 SCC 302, it is pursuant to Entry 66 of List I thatthe University Grants Commission (hereinafter referred to as ‘UGC’) wasestablished under Section 4 of the University Grants Commission Act,1956. As stated in the Statement of Objects and Reasons appended to theAct, UGC has the power to recommend to any University the measuresnecessary for the reform and improvement of University education and toadvise the University concerned upon the action to be taken for thepurpose of implementing such recommendations. UGC has to act as anexpert body to advise the Central Government on problems connectedwith the coordination of facilities and maintenance of standards inUniversities.
