Qualitative Improvement of the Legal Profession 431. In laying down the standards of Legal Education, theBar Council's “Legal Education Committee” constitutedunder Rule 4 of Chapter III of the Bar Council of IndiaRules, 1965 must reflect the participation ofrepresentatives of (1) the Judiciary, (2) the Bar Counciland (3) the U.G.C. It is proposed that the Rules beamended and the Legal Education Committee berestructured to involve the bodies above-mentioned.12. Rule 21 of the Bar Council Rules directing that everyUniversity shall endeavour to supplement the lecturemethod with case method, tutorials and other moderntechniques of imparting Legal Education must beamended in a mandatory form and it should includeproblem method, moot courts, mock trials and otheraspects and make them compulsory.13. (i) Participation in moot courts, mock trials, anddebates must be made compulsory and marks awarded,(ii) Practical training in drafting pleadings, contractscan be developed in the last year of the study, and (iii)Students' visits at various levels to the Courts must bemade compulsory so as to provide a greater exposure.15. Entrance into the Bar after 12 months or 18 monthsof Apprenticeship with Entry Examination. Forobtaining the License/Sanad from State Bar Councils itmust be prescribed that one should secure at least 50per cent or 60 per cent marks at the Bar CouncilExamination.16. So far as the training under a Senior Lawyer duringthe period of one year or 18 months of apprenticeship,REPORT OF 3-MEMBER COMMITTEE ON REFORM OF LEGAL EDUCATION
Qualitative Improvement of the Legal Profession 44the Act or the Rules must stipulate that the senior musthave at least 10 or 15 years' standing at the DistrictCourt/High Court and the student's diary must reflecthis attendance for three months in the grass root level ina civil court and for three months in a Magistrate’scourt and at least six months in a district court. TheAdvocate in whose office he works must also certify thatthe student is fit to enter the Bar. Unless theseformalities are completed, the student should not bepermitted to sit for the Bar Council Examination.32. It is true that these suggestions of the High PowerCommittee clearly highlighted the crying need for improvingthe standards of legal education and the requirements for newentrants to the legal profession of being equipped withadequate professional skill and expertise. There also cannot beany dispute on this aspect…”The Supreme Court was of the firm opinion that the requirements ofapprenticeship and bar examination were very essential for the qualitativeimprovement of the legal profession; however, such requirements had tobe introduced by way of statutory amendments, and could not beprovided for through subordinate legislation.It is, therefore, apparent from the above analysis that the requirements ofapprenticeship and bar examination are extremely pivotal in ensuringhigh standards of the legal profession.It must be noted that theintroduction of such a requirement would (i) prevent law schools fromescaping the high standards imposed by the governing legal educationREPORT OF 3-MEMBER COMMITTEE ON REFORM OF LEGAL EDUCATION
