Our member publishers areworking c<strong>on</strong>stantly with faculty to determine <strong>the</strong>ir instructi<strong>on</strong>al needs and <strong>the</strong> learning needs <strong>of</strong>students to raise <strong>the</strong> nati<strong>on</strong>al standards for course c<strong>on</strong>tent and instructi<strong>on</strong>.I have attached AAP’s detailed comments <strong>on</strong> <strong>the</strong> report for your review, but wanted to highlighta few key issues.1) We’ve learned that <strong>the</strong> focus <strong>of</strong> <strong>the</strong>se kinds <strong>of</strong> reports center <strong>on</strong> lowering studentspending <strong>on</strong> textbooks, not regulating <strong>the</strong> price <strong>of</strong> textbooks or issuing price c<strong>on</strong>trols.Pricing issues raise c<strong>on</strong>stituti<strong>on</strong>al questi<strong>on</strong>s. Regulating <strong>the</strong> business practices <strong>of</strong> <strong>the</strong>textbook publishing industry by forced unpackaging, forced d<strong>on</strong>ati<strong>on</strong> <strong>of</strong> samples or limits<strong>on</strong> new editi<strong>on</strong>s violates <strong>the</strong> First Amendment to <strong>the</strong> C<strong>on</strong>stituti<strong>on</strong> and <strong>the</strong> U.S. CommerceClause.2) As we indicated in our resp<strong>on</strong>se to your questi<strong>on</strong>naire, publishers cannot provide facultywith <strong>the</strong> price <strong>of</strong> course materials sold at <strong>the</strong> bookstore.
