Manybookstores dislike <strong>the</strong> cost <strong>of</strong> handling numerous items and <strong>the</strong> requirement for additi<strong>on</strong>al shelfspace, and faculty object when students do not select <strong>the</strong> full range <strong>of</strong> materials <strong>the</strong> faculty hasordered, because <strong>the</strong> faculty believe all <strong>of</strong> <strong>the</strong> materials are necessary for <strong>the</strong>ir students successfulcompleti<strong>on</strong> <strong>of</strong> <strong>the</strong>ir class.• Bullet 5 – “publishers to provide…price <strong>of</strong> course materials sold at <strong>the</strong> bookstores” – Publisherscannot meet this requirement. Only bookstores can provide retail prices. Publishers sell <strong>the</strong>irproducts to bookstores at wholesale. The chief c<strong>on</strong>cernsexpressed are that any <strong>on</strong>e <strong>of</strong> <strong>the</strong>se Committees, without careful administrative and legalguidance, will establish policies or practices that are bey<strong>on</strong>d <strong>the</strong>ir purview, infringe <strong>on</strong> academicfreedom or are illegal and subject to litigati<strong>on</strong>.Faculty• Bullet 2 – “Place course materials <strong>on</strong> reserve” – Academic departments in o<strong>the</strong>r states have raisedstr<strong>on</strong>g objecti<strong>on</strong> to this requirement due to <strong>the</strong> cost <strong>of</strong> purchasing <strong>the</strong> materials and <strong>the</strong> cost anddifficulties <strong>of</strong> administering <strong>the</strong> program.• Bullet 3 – “Adopt new editi<strong>on</strong>s <strong>on</strong>ly when significant changes occur.” – This requirement raises<strong>the</strong> questi<strong>on</strong>s <strong>of</strong> what is significant and to whom? A detailed descripti<strong>on</strong> <strong>of</strong> <strong>the</strong> changes made innew editi<strong>on</strong>s is printed in <strong>the</strong> foreword <strong>of</strong> <strong>the</strong> textbook being <strong>of</strong>fered. This is an almost universalpractice employed by publishers as part <strong>of</strong> <strong>the</strong>ir marketing regimen. If <strong>the</strong> faculty or departmentmaking <strong>the</strong> adopti<strong>on</strong> does not believe <strong>the</strong> changes are sufficient to warrant a change <strong>the</strong>y can stickwith <strong>the</strong> old editi<strong>on</strong> – a comm<strong>on</strong> practice that is overlooked by some critics – or choose ano<strong>the</strong>rtext from ano<strong>the</strong>r publisher. Some departments require <strong>the</strong>ir instructors to choose new editi<strong>on</strong>s t<strong>of</strong>orce <strong>the</strong> faculty to remain current and c<strong>on</strong>sistently update <strong>the</strong>ir classroom lectures. The vastmajority <strong>of</strong> faculty prefer <strong>the</strong> newest editi<strong>on</strong>s because <strong>of</strong> c<strong>on</strong>tent and improvements in pedagogy,according to a nati<strong>on</strong>al study <strong>of</strong> faculty by Zogby Internati<strong>on</strong>al.Publishers• Bullet 1 – “Provide complimentary copies <strong>of</strong> selected textbooks…” – Publishers at <strong>the</strong>ir owndiscreti<strong>on</strong>, already distribute milli<strong>on</strong>s <strong>of</strong> copies <strong>of</strong> complimentary copies <strong>of</strong> textbooks and o<strong>the</strong>rcourse materials. However, as noted earlier, this requirement can nei<strong>the</strong>r be required nor impliedas a c<strong>on</strong>diti<strong>on</strong> <strong>of</strong> doing business.• Bullet 2 – “Offer bundled materials as separate items for purchase.” – Publishers generally <strong>of</strong>fersupplemental materials separately if <strong>the</strong>y are ordered in this fashi<strong>on</strong> by <strong>the</strong> faculty or adepartment and also supply materials separately for sale with used textbooks. In some instancespublishers have third-party c<strong>on</strong>tractual agreements, for items such as s<strong>of</strong>tware, that prohibit thispractice.
