(Ord. 1999 FC-1 § 1 (part), 1999; Ord. 1988 FC-2 Art. 4(part), 1988)16.08.220Encroachment, equal degree <strong>of</strong>."Encroachment" means <strong>the</strong> advancement or infringement placement <strong>of</strong> uses, materials, fill, orstructures into any <strong>the</strong> regulatory floodplain in a manner that impedes or adversely modifies <strong>the</strong>flow conveyance capacity <strong>of</strong> <strong>the</strong> channel and/or regulatory floodplain <strong>of</strong> a watercourse.A. An "equal degree <strong>of</strong> encroachment" is <strong>the</strong>a standard applied to <strong>the</strong> evaluation <strong>of</strong> <strong>the</strong> effects <strong>of</strong>an encroachment within <strong>the</strong> regulatory floodplain with respect to <strong>the</strong> degree in which increase inflood water heights or flow velocities may be changed in <strong>the</strong> primary channel as a result <strong>of</strong> <strong>the</strong>encroachment. and A. An "equal degree <strong>of</strong> encroachment" assumes that an encroachment, ifpermitted, may confer on all property owners on both sides <strong>of</strong> <strong>the</strong> watercourse are provided withan equal right to encroach to <strong>the</strong> same degree within that reach <strong>of</strong> <strong>the</strong> watercourse and modify<strong>the</strong> flow capacity within <strong>the</strong> floodplain including increasing <strong>the</strong> flood height or flow velocity.within <strong>the</strong> primary channel.B. Since <strong>the</strong> factors affecting hydraulic efficiency are usually not uniform within a reach, thisstandard may not result in equally measured distances between floodway limit lines and <strong>the</strong>regulatory floodplain boundaries <strong>of</strong> a watercourse.C. In order to preserve <strong>the</strong> floodway and floodplain flow conveyance capacity, for all propertyowners, <strong>the</strong> degree <strong>of</strong> allowed encroachment is limited to a rise <strong>of</strong> no more than 0.1 feet orvelocity increase <strong>of</strong> no more than 10% as measured at property lines.D. As approved by <strong>the</strong> Chief Engineer on a case-by-case basis based on an engineering analysisand a determination <strong>of</strong> noadverse impacts to adjacent properties. (Ord. 1999 FC-1 § 1(part), 1999; Ord. 1988 FC-2 Art. 4 (part), 1988)16.08.250Exemption."Exemption" to this title means that a federal, state and/or local law has identified a land use,construction activity, and/or o<strong>the</strong>r action as allowed and immune to local regulations.
