The staff report shall be made available to the applicant and other interestedparties at least 15 days before the date of any public hearing for the respective petition.6. The Board shall render its decision within 30 days of the close of the hearing.7. The Board may meet monthly, or at such times as it deems necessary for the transaction ofbusiness, including the hearing of appeals and variances petitions.B. The following application and hearing procedures apply to an appeal of a written violationnotice from the Chief Engineer, or a variance request, or combination thereof.C. In addition to the above described hearing procedure, the Board's public hearing process forviolations and enforcement actions shall include the following:1. A mailed notification of the hearing to all parties who received a notice of the violation, aswell as all other parties who attended the violation hearing at which the Chief Engineer tookaction,2. An opportunity for property owners and residents within a minimum distance of 300 feet ofthe boundaries of the property violation shall be provided in order to allow an opportunity tomake comments on the appeal or variance request petitions, and2. The Chief Engineer may refer appeal or variance requests of a technical nature to theTechnical Review Committee. The Technical Review Committee shall hold a hearing to makefindings and recommendations to the Board within 30 days of receipt of the petition from theChief Engineer.3. Review by the Chief Engineer and the Technical Review Committee of the appeal by theappellant, the final staff report, and the circumstances and testimony presented at the hearing bythe Chief Engineer and Technical Review Committee, when such hearings are held.3. Section 26-321, the land upon which thestructure is located is ineligible for acquisition under the County Floodprone Land AcquisitionProgram, and notice that the structure increase risks to life and property and will result inincreased flood insurance premium rates A copy of the notice shall be recorded by the Board inthe office of the County Recorder and shall be recorded in a manner so that it appears in thechain of title of the affected parcel of land. Section 48-3610, whenever a variance to federal and/or statefloodplain requirements contained in this title and is within 1 mile of the boundary between theDistrict's area of jurisdiction and the jurisdiction of a city or town, then the District shall advise,in writing, the city or town and provide a copy of any development plan or any application thathas been filed with the District for a floodplain use permit or variance. Written notice and a copy of the plan of development shall be sent to any adjacentjurisdiction no later than 3 working days after having been received by the District.
