From <strong>the</strong> effective date <strong>of</strong> <strong>the</strong> title, aA floodplain use permit must shall be obtained from <strong>the</strong>District for any new structures, new manufactured homes, replacement <strong>of</strong> an existingmanufactured home or travel trailer, a change <strong>of</strong> use <strong>of</strong> any portion <strong>of</strong> an existing structure,substantial improvements or o<strong>the</strong>r improvements to a structures andor manufactured homeswhere <strong>the</strong> value <strong>of</strong> material and labor exceeds $7,500, or any o<strong>the</strong>r development upon any landslying located within:1. FEMA designated Special Flood Hazard Areas, Flood Hazard Boundary Maps, or FloodInsurance Rate Maps;2. Aall o<strong>the</strong>r regulatory floodplains as described in chapters 16.08, 16.24 and 16.26;3. Rriparian habitat areas as described in Chapter 16.30; or4. within eErosion hazard areas as described in Chapter 16.28 <strong>of</strong> this title.B. It shall be unlawful for such activities to take place without first applying for and obtaining aFfloodplain uUse pPermit from <strong>the</strong> Chief Engineer, and <strong>the</strong>reafter complying with each andevery written termall conditions <strong>of</strong> <strong>the</strong> floodplain use permit and all provisions <strong>of</strong> this Title.(Ord. 2010 FC-1)16.20.015 Floodplain use permit - Exemptions.A. However, no such fA floodplain use permit shall not be required for any structure that is lessthan 200 square feet, or for <strong>the</strong> repairs or alterations <strong>of</strong> an existing structure for which <strong>the</strong> value<strong>of</strong> <strong>the</strong> materials and labor <strong>the</strong>reon does not exceed $7,500, except for those provided that <strong>the</strong>improvements:1. Do not which obstruct, divert, or retard <strong>the</strong> flow <strong>of</strong> flood water, or2. Do not disturb or remove riparian habitat, as regulated under this tTitle, and3. Comply with all o<strong>the</strong>r provisions <strong>of</strong> this Title including requirements for flood venting and foranchoring to prevent lateral movement.B. Exempt structures that are found to be constructed in violation <strong>of</strong> this Title may require apermit in order to bring <strong>the</strong> structure in compliance.C. For <strong>the</strong> purpose <strong>of</strong> determining <strong>the</strong> value <strong>of</strong> any such repairs or alterations, <strong>the</strong> normal retailvalue <strong>of</strong> materials and <strong>the</strong> reasonable value <strong>of</strong> <strong>the</strong> labor performed shall be used. Although n<strong>of</strong>loodplain use permit is required, all o<strong>the</strong>r provisions <strong>of</strong> this title shall be observed in <strong>the</strong>33
