Land which contains areas within a regulatory floodplain or erosion hazard area shall not beplatted for residential occupancy or building sites unless each lot contains a building site, ei<strong>the</strong>rnatural or manmade, which is not subject to flooding or erosion by <strong>the</strong> base flood.B. Lots shall be configured so that encroachment into <strong>the</strong> regulatory floodplain and erosionhazard area is minimized. It is preferred that building sites and o<strong>the</strong>r development be locatedoutside <strong>of</strong> <strong>the</strong> regulatory floodplain and erosion hazard area.C. In regulatory floodplain areas where fill is to be used to raise <strong>the</strong> elevation <strong>of</strong> <strong>the</strong> building site,<strong>the</strong> building shall be located not less than 25 10 feet landward from any edge <strong>of</strong> <strong>the</strong> fill, andprotected from erosion in accordance with 16.26.040, unless a study/analysis prepared and sealedby an Arizona registered pr<strong>of</strong>essional civil engineer demonstrates a lesser distance or <strong>the</strong> absence<strong>of</strong> erosion protection is acceptable. No fill shall be placed in any regulatory floodplain orfloodway, nor shall any fill be placed where it diverts, retards or obstructs <strong>the</strong> flow <strong>of</strong> water tosuch an extent that it creates a danger or hazard to life or property.D. Any Dwelling Unit built within a regulatory floodplain shall be constructed so as to place <strong>the</strong>minimum finished floor elevation <strong>of</strong> <strong>the</strong> lowest floor <strong>of</strong> <strong>the</strong> Dwelling Unit at or above <strong>the</strong>regulatory flood elevation.E. All building sites shall be graded and compacted to comply with FEMA regulations for filland to comply with foundation elevation requirements under <strong>the</strong> international uniform buildingcode, and shall be graded and compacted so that <strong>the</strong> top <strong>of</strong> any exterior foundation shall extendabove <strong>the</strong> elevation <strong>of</strong> <strong>the</strong> street gutter at <strong>the</strong> point <strong>of</strong> discharge, or above <strong>the</strong> inlet <strong>of</strong> an approveddrainage device, a minimum <strong>of</strong> 12 inches plus 2 percent for a minimum <strong>of</strong> 25 feet away from <strong>the</strong>foundation, but in no case should <strong>the</strong> finished floor elevation <strong>of</strong> habitable structures be below <strong>the</strong>regulatory flood elevation. (Ord. 2010 FC-1; Ord. 2005 FC-2 § 2 (part), 2005; Ord. 1999 FC-1 §1 (part), 1999; Ord. 1988 FC-2 Art. 11 (D), 1988)16.36.080Setbacks from channels.Along reaches <strong>of</strong> watercourses where hazards from eroding banks or channel meandering areconsidered by <strong>the</strong> Chief Engineer to be severe, special engineering studies, prepared and sealedby an Arizona registered pr<strong>of</strong>essional civil engineer shall be required <strong>of</strong> <strong>the</strong> property owner ordeveloper; and requirements for setbacks from banks <strong>of</strong> watercourses and/or o<strong>the</strong>r protectionmeasures shall be established in accordance with <strong>the</strong> approved studies.
