Within a regulatory floodplain or sheet flood zone, any activity that may have an effect on <strong>the</strong>flow <strong>of</strong> storm water run<strong>of</strong>f, or flood water, storm water quality, or that may effect <strong>the</strong> erosion or<strong>the</strong> sediment carrying capacity <strong>of</strong> a watercourse, is subject to this title and to <strong>the</strong> provisions <strong>of</strong>this chapter.B. Prior to receiving a floodplain use permit, both temporary and permanent measures forsediment and erosion control must be clearly delineated on plans or o<strong>the</strong>r written documents.The Grading Design Manual, prepared pursuant to Chapter 18.81 <strong>of</strong> <strong>the</strong> zoning code, and o<strong>the</strong>rdesign standards, as approved by <strong>the</strong> Chief Engineer, shall be used to prepare <strong>the</strong>se plans ordocuments. (Ord. 2010 FC-1; Ord. 2005 FC-2 § 2 (part), 2005)16.42.020Soil investigations.The Chief Engineer may require appropriate soil investigation reports for <strong>the</strong> purpose <strong>of</strong>determining <strong>the</strong> erosive properties <strong>of</strong> areas or lands to be graded or disturbed, and which maycreate sediment deposition or erosion in any floodplain or floodprone area regulated by this title.(Ord. 2005 FC-2 § 2 (part), 2005)16.42.030Grading or alteration <strong>of</strong> watercourses.A. Any grading or <strong>the</strong> alteration <strong>of</strong> any watercourse regulated by this title shall be performed in acontrolled manner in order to minimize <strong>the</strong> loss <strong>of</strong> soil through erosion from rainfall or stormwater flow. Prior to granting a floodplain use permit for work in any floodplain, methods tocontrol erosion and sedimentation during construction and post-construction must bedemonstrated to be appropriate to <strong>the</strong> satisfaction <strong>of</strong> <strong>the</strong> Chief Engineer.B. Due to <strong>the</strong> rapidly changing hydraulic characteristics <strong>of</strong> watercourses within <strong>the</strong> <strong>County</strong>, and<strong>the</strong> effects that sand and gravel mining and o<strong>the</strong>r excavations have on <strong>the</strong>se hydrauliccharacteristics, floodplain use permits for grading and construction shall only be issued for alimited time period, not to exceed one year, subject to annual renewal and upon review by <strong>the</strong>Chief Engineer.C. In addition to those conditions provided for elsewhere, floodplain use permits for excavationsmay impose conditions regarding <strong>the</strong> area and location in which excavations are allowed, <strong>the</strong>maximum amount <strong>of</strong> material to be excavated, mining mitigation plans and o<strong>the</strong>r reasonablerestraints on <strong>the</strong> methods <strong>of</strong> operating including time restraints.65
