(Ord. 1999 FC-1 § 1 (part), 1999; Ord. 1988 FC-2 Art.18 (A), 1988)16.60.020Petition, study and determination procedures.The Chief Engineer or any affected person may petition for an amendment to this title, and shallinitiate such a proceeding by filing with <strong>the</strong> Board a proper and complete petition for suchchange on <strong>the</strong> form or forms provided by <strong>the</strong> Board.A. Staff Report. Upon receipt <strong>of</strong> such petitions, <strong>the</strong> Chief Engineer, with <strong>the</strong> assistance, adviceand counsel <strong>of</strong> <strong>the</strong> Flood Control District Advisory Committee, <strong>the</strong> <strong>County</strong> Zoning Inspector,and <strong>the</strong> <strong>County</strong> Planning Director, shall make a study and report <strong>the</strong> findings to <strong>the</strong> Board. Thereport shall be made available to <strong>the</strong> applicant and o<strong>the</strong>r interested parties at least 30 days before<strong>the</strong> date <strong>of</strong> any public hearing for <strong>the</strong> respective petition.B. Board Action. Upon receipt <strong>of</strong> <strong>the</strong> Chief Engineer report and recommendation, <strong>the</strong> Boardshall hold a public hearing <strong>the</strong>reon at which <strong>the</strong> petitioner and o<strong>the</strong>r parties in interest have anopportunity to be heard. At least 30 days prior to <strong>the</strong> hearing, a notice <strong>of</strong> <strong>the</strong> time and place <strong>of</strong>hearing shall be published in a newspaper <strong>of</strong> general circulation within <strong>the</strong> area <strong>of</strong> jurisdiction <strong>of</strong><strong>the</strong> Board; or, if no newspaper <strong>of</strong> general circulation is regularly published within <strong>the</strong> area <strong>of</strong>jurisdiction, a newspaper <strong>of</strong> general circulation regularly published nearest <strong>the</strong> area <strong>of</strong>jurisdiction.C. A notice <strong>of</strong> any hearing, accompanied by a copy <strong>of</strong> each <strong>of</strong> <strong>the</strong> proposed amendments, shallbe furnished to <strong>the</strong> director <strong>of</strong> <strong>the</strong> ADWR at least 30 days prior to <strong>the</strong> date <strong>of</strong> such hearing. Acopy <strong>of</strong> any amendment adopted by <strong>the</strong> Board shall, within 5 days <strong>the</strong>reafter, be file with <strong>the</strong>director <strong>of</strong> <strong>the</strong> ADWR.
