By that it is not a guilt, it is meant that theowner will not be judged and punished for it in the next world.However, he will not gain the rewards of having performedcharitable deeds, of having used such property in commerceand arts, and of having helped Islam and Muslims; he cannotattain high degrees in the next world. Great scholar Hadrat ’Abdal-Ghanî an-Nablusî wrote in his book al-Hadîqa that zakâtprotected property against harm. Rasûlullah (’alaihi ’s-salâm)said, “Protect your property from harm by paying its zakât.”This hadîth is written also in al-Manâwî’s Kunûz ad-daqâ’iqwith its source. When the âyat, “There is very bitterpunishment for those who conceal their golds and silversand who do not distribute them in Allâhu ta’âlâ’s way,”descended, Rasûlullah (’alaihi ’s-salâm) said, “Zakât wascommanded in order to purify Muslims’ possessions. Theproperty whose zakât is given will not be kanz, that is, itwill not be considered as property which is stored.” Ahadîth declares, “There is very bitter punishment in the nextworld because of the property whose zakât has not beengiven.” Sayyid Qutb wrote as if he did not believe thesehadîths. It is declared in a hadîth reported by at-Tabarânî andal-Manâwî, “The property whose zakât has been given isnot kanz.” Rasûlullah (’alaihi ’s-salâm) said that the propertywhose zakât was given would not be considered as storedproperty, and Sayyid Qutb said that this was incorrect. Thisshows what kind of a person Sayyid Qutb was.53 - Again in World’s Peace and Islam, he wrote:“The government takes not only the tax but also part ofpersonal property as much as it needs free and not to bereturned. It spends it on general needs of the society.”Jewdet Pasha, who put Allâhu ta’âlâ’s commands into theform of law-articles, says in the 95th article of his Majalla, “Onecannot command anybody to use others’ property.” Forexample, one cannot command anybody to give a certainperson’s property to another person. It is written on its 96tharticle and in ad-Durr al-mukhtâr, “A person’s propertycannot be used without his permission.” Property issomething which one possesses. A hadîth says, “If a Muslim’sproperty is taken without his consent, it will not be halâl.”This hadîth sherîf is written in the book Kunûz ad-daqâ’iq byImâm al-Manâwî, in Musnad by Imâm Ahmad and in Sunan by- 214 -
