the discretion of the Associate Dean of Student Affairs or the Student Affairs Council.<br />
- More severe penalties may be applied based on a student’s previous behavior or severity of the incident.<br />
- Residence Life has the right to refer disciplinary cases to Student Affairs for adjudication.<br />
- In cases of academic dishonesty faculty have the responsibility of administering academic consequences.<br />

In order to establish an internal review at the university level that provides an<br />
opportunity for students charged with violations of University policies, as set forth in<br />
guidelines for student conduct, the University Judicial Council (UJC) was established.<br />
Jurisdiction<br />
Where sanctions have been administered by an agent of the institution having original<br />
jurisdiction to hear and decide questions of student conduct that run counter to the<br />
guidelines set forth in the Student Handbook, it is the responsibility of the Judicial<br />
Council to review cases upon appeal if it meets one of the following criteria:<br />
- new evidence relative to the original outcome<br />
- procedural error by the original adjudicating agent (or group) that had a<br />
detrimental effect on the outcome of the hearing<br />
- inappropriate sanction based on the policy violation<br />
If an appeal is successful the UJC will require a new hearing of the case by the original<br />
adjudicating body, or a new adjudicating body, and that outcome is final. The<br />
University President shall have final appellate jurisdiction in all cases of indefinite<br />
suspension or disciplinary dismissal. Final appeal of decisions of indefinite suspension<br />
or disciplinary dismissal will be filed within three academic days following notification<br />
of the sanction with the Office of the President of the University and shall be adjudicated<br />
by the President as promptly as possible.<br />
Procedure<br />
A student must request a review of his/her case within five academic days of oral<br />
notification to the student of the initial adjudicating body’s decision (appeal request<br />
form). The Dean of Students and another member of the UJC will review the student’s<br />
reason(s) to request an appeal along with any relevant documentation involving the<br />
original decision. An appeal will be granted only if there appears to be: new evidence of<br />
