The Sexual Misconduct Proceedings set forth below deviate from the University’s process<br />
relative to other alleged violations of conduct in order to conform to Title IX guidelines and<br />
Office of Civil Rights recommendations. The proceedings are outlined below:<br />
Student reports a sexual assault<br />
by another student to a campus<br />
official<br />
Complainant offered<br />
immediate medical,<br />
counseling, and protective<br />
services<br />
If anonymity is requested, the<br />
University informs the<br />
complainant that its ability to<br />
respond may be limited.<br />
Official immediately refers report to<br />
the Office of Student Affairs or<br />
Public Safety<br />
Complainant meets with a Student<br />
Affairs Dean for complete overview of<br />
support services and accommodations,<br />
protection from retaliation, no contact<br />
arrangements, reporting options, and<br />
University procedures.<br />
EXCEPTION<br />
Staff in the University’s<br />
Health and Wellness<br />
Services Office are not<br />
required to report incidents<br />
of sexual misconduct<br />
without a student’s consent.<br />
Complainant requests to<br />
proceed with a University<br />
investigation and hearing.<br />
Complainant decides not to move<br />
forward with a University<br />
investigation.<br />
Based on preliminary<br />
investigation, the Student<br />
Affairs Dean does not<br />
find *cause to move<br />
forward.<br />
Based on preliminary<br />
investigation, the<br />
Student Affairs Dean<br />
finds *cause to move<br />
forward<br />
The University evaluates the request in the<br />
context of obligation to protect the campus<br />
community.<br />

Both complainant and accused can<br />
request appeal based on new<br />
evidence, procedural error in original<br />
hearing, or inappropriate sanction<br />

*A determination of “no cause” would be made in situations that include: a) The mutual accounts of the episode do not meet the criteria for the<br />
University’s definition of sexual misconduct, b) Preliminary evidence is uncovered to positively repudiate the sexual misconduct allegation.<br />
