The Sexual Misconduct Proceedings set forth below deviate from the University’s process
relative to other alleged violations of conduct in order to conform to Title IX guidelines and
Office of Civil Rights recommendations. The proceedings are outlined below:
Student reports a sexual assault
by another student to a campus
official
Complainant offered
immediate medical,
counseling, and protective
services
If anonymity is requested, the
University informs the
complainant that its ability to
respond may be limited.
Official immediately refers report to
the Office of Student Affairs or
Public Safety
Complainant meets with a Student
Affairs Dean for complete overview of
support services and accommodations,
protection from retaliation, no contact
arrangements, reporting options, and
University procedures.
EXCEPTION
Staff in the University’s
Health and Wellness
Services Office are not
required to report incidents
of sexual misconduct
without a student’s consent.
Complainant requests to
proceed with a University
investigation and hearing.
Complainant decides not to move
forward with a University
investigation.
Based on preliminary
investigation, the Student
Affairs Dean does not
find *cause to move
forward.
Based on preliminary
investigation, the
Student Affairs Dean
finds *cause to move
forward
The University evaluates the request in the
context of obligation to protect the campus
community.
Investigatio
n ends.
Complainant can join
hearing via video
conference if more
comfortable.
Both the complainant
and accused have
equal opportunity to
provide witnesses
and bring an advisor
of their choice.
Investigator meets with
complainant, accused,
and witnesses to
prepare incident
reports.
A hearing takes place
before the
Administrative
Committee on Sexual
Misconduct.
The Administrative Committee on
Sexual Misconduct issues findings (in
some cases sanctions) based upon
preponderance of the evidence
standard. Findings shared with
complainant and accused in writing.
If University
investigator
determines the
accused student
is a threat to
complainant or
others on campus
the investigation
continues with
steps taken to
respect
confidentiality.
If University
investigator
determines the
accused student
is not a threat
the investigation
ends.
Both complainant and accused can
request appeal based on new
evidence, procedural error in original
hearing, or inappropriate sanction
relative to policy violation.
*A determination of “no cause” would be made in situations that include: a) The mutual accounts of the episode do not meet the criteria for the
University’s definition of sexual misconduct, b) Preliminary evidence is uncovered to positively repudiate the sexual misconduct allegation.
