The first po<strong>in</strong>t is, is this dogma orig<strong>in</strong>al or is this a new contention raised at sometime later <strong>in</strong> the history of<br />

India. The general view is that it is the orig<strong>in</strong>al doctr<strong>in</strong>e. A reference to the Dharma Sutras which are the<br />

earliest law books which deal with this subject go to show that this is not a correct view. The Gautama<br />

Dharma Sutra lays down the follow<strong>in</strong>g rule on the question of the <strong>in</strong>fallibility of the vedas. "The Veda is<br />

the source of the sacred law". I.I.<br />

" And the tradition and practice of those who know the (Veda)<br />

"— 1.2.<br />

"If (authorities) of equal force are conflict<strong>in</strong>g (either may be followed at) pleasure" 1.4. The Vashishta<br />

Dharma Surta propounds the follow<strong>in</strong>g view:<br />

"The Sacred law has been settled by the revealed texts and by the tradition of the sages " 1.4. " On the<br />

failure of (rules given <strong>in</strong>) these (two sources) the practice of Shistas has authority." I.s.<br />

"He whose heart is free from desire (is called) a shista" 1.6. The views of Baudhayana are given below:<br />

Prasna 1, Adhyaya 1, Kandika 1.<br />

1. The sacred law is taught <strong>in</strong> each Veda.<br />

2. We will expla<strong>in</strong> (it) <strong>in</strong> accordance with that.<br />

3. (The sacred law), taught <strong>in</strong> the Tradition (Smriti, stands) second.<br />

4. The practice of the Sishtas (stands) third.<br />

5. Sishtas, forsooth, (are those) who are free from envy, free from pride, contented with a store of gra<strong>in</strong><br />

sufficient for ten days, free from covetousness, and free from hypocrisy, arrogance, greed, perplexity, and<br />

anger.<br />

6. ' (Those are called) Sishtas who, <strong>in</strong> accordance with the sacred law, have studied the Veda together with<br />

its appendages, know how to draw references from that, (and) are above to adduce proofs perceptible by the<br />

senses from the revealed texts'.<br />

7. On failure of them, an assembly consist<strong>in</strong>g at least of ten members (shall decide disputed po<strong>in</strong>ts of law).<br />

8. Now they quote also (the follow<strong>in</strong>g verses): ' Four men, who each know one of the four Vedas, a<br />

Mimansaka, one who knows the Angas, one who recites (the works on) the sacred law, and three<br />

brahamanas belong<strong>in</strong>g to (three different) order, (constitute) an assembly consist<strong>in</strong>g, at least of ten<br />

members'.<br />

9. ' There may be five, or there may be three, or there may be one blameless man, who decides (questions<br />

regard<strong>in</strong>g) the sacred law. But a thousand fools (can) not (do it). '<br />

10. 'As an elephant made of wood, as an antelope made of leather, such an unlearned Brahmana; those<br />

three hav<strong>in</strong>g noth<strong>in</strong>g but the name (of their k<strong>in</strong>d)'.<br />

The view taken by the Apastamba Dharma Sutra is clear from the follow<strong>in</strong>g extract from that Sutra:<br />
