Abakozi n’abayobozi ntibagomba gufata icyemezo
babitewe n’ubucuti cyangwa ishyirahamwe
bahuriyemo, haba mu gukurikiza iby’umukiriya
asaba, cyangwa mu kugaragaza ko ibyo asaba
byubahirizwa. Ibyo byemezo bigomba gufatwa
hashingiwe gusa ku bucuruzi bukozwe mu ipigana.

Iyo bigenze bityo, ubwo bwumvikane bugomba
kuba bwubahirije amategeko, byasuzumwe
hashingiwe ku bisanzwe bisabwa mu gukorana
ubucuruzi kandi bigasobanurwa bihagije ndetse
bikemezwa n’Inama y’ubuyobozi cyangwa urundi
ruhande rwigenga.
Ingingo ya 46: Inguzanyo zihabwa umuntu ufite
ububasha bwo gufata icyemezo muri banki
Abayobozi, abayobozi bakuru n’ubuyobozi
babujijwe gukoresha imyanya barimo bateza imbere
inyungu zabo bwite. Ni yo mpamvu, mu Rwanda,
ikigo kibujijwe:
1. guha cyangwa kwemerera avansi abakozi
bacyo cyangwa abo bafatanyije bakomeje
kukibamo avansi itishyuwe bahawe nta
ngwate batanze;
2. guha cyangwa kwemerera avansi, imyenda,
cyangwa inguzanyo abakozi bacyo, abafite
imigabane igaragara cyangwa abo

Staff and directors must not be influenced by
friendship or association, either in meeting a
customer’s requirement, or in recommending that
they be met. Such decisions must be made on a
strictly arms-length business basis. All preferential
transactions with insiders or related interests
should be avoided.
If transacted, such dealings should be in full
compliance with the law, judged on normal
business criteria basis and fully documented and
duly authorized by the Board of Directors or any
other independent party.
Article 46: Insider Loans
Directors, chief executive officers and management
should not use their positions to further their
personal interests. An institution shall not in
Rwanda therefore:
1. Grant or permit to be outstanding any
unsecured advances in respect of any of its
employees or their associates;
2. Grant or permit to be outstanding any
advances, loans or credit facilities which
are unsecured or advances, loans or credit

être influencés par leurs liens d’amitié ou
d’association soit pour satisfaire les exigences d’un
client ou recommander la satisfaction de ces
exigences. De telles décisions doivent être prises
de façon strictement indépendante. Il convient
d’éviter toutes les opérations préférentielles avec
des personnes ou des intérêts apparentés.
Si elles sont conclues, de telles transactions
devraient être totalement conformes à la loi,
appréciées sur la base des critères commerciaux
ordinaires et entièrement documentées et dûment
autorisées par le Conseil d’administration ou toute
autre partie indépendante.
Article 46 : Prêts aux inities
Les administrateurs, directeurs généraux et
membres du personnel ne doivent pas se servir de
leur position afin de promouvoir leurs intérêts
personnels. En conséquence, toute institution
établie au Rwanda ne devra pas:
1. accorder ou autoriser l’octroi d’avances
non garanties à un de ses employés ou les
associés de ceux-ci ;
2. octroyer ou permettre l’octroi d’avances,
prêts ou facilités de crédit qui ne sont pas
totalement garantis à un de ses agents,
