groot: zij konden dan immers kiezen voor een school (KDC in de Tyltylschool) of
voor een KDC. Dit pervers onderzoeksvoorstel werd door het ministerie afgewezen.
14.47 Tussen 2001 en 2005 heeft Sterre daarna op een reguliere basisschool in Almere
in de groepen 5 t/m 8 gezeten. De ervaringen op de basisschool waren uitsluitend
positief.
14.48 Tijdens het inroepen van de hulp van het REC (zie 14.12 e.v.) kon of wilde het
REC niet aangeven wat en of er iets veranderd was waardoor de Tyltylschool nu
wel beter in staat zou zijn kwalitatief goed onderwijs voor Sterre te garanderen
[PRODUKTIE g4].
14.49 Onderzoek, in juni 2007 leidend tot een proefschrift [PRODUKTIE x7], wees uit
dat het recht op onderwijs dat de lgf wilde effectueren voor “ondergrensleerlingen”
niet geëffectueerd en mislukt is.

14.50 Applicants are parents and legal representatives of Sterre V. Ploeger, born 11 June
1991. Sterre has Special Educational Needs (SEN). Sterre is statemented as “MGcluster
3”. After new legislation came into force (2003, Leerlinggebonden Financiering,
LGF, Rugzakje) this statement entitled Sterre to enrol in a special school
that offers “Tyltylonderwijs” or in a mainstream school in which case the school
gets extra funding.
14.51 Sterre left primary school in the schoolyear ending 1 August 2005. Compulsory
education in the Netherlands is till the age of 18 years. For Sterre this will be till
2009. No schools in the Netherlands will or can admit Sterre after the primary
school.
14.52. Applicants consider this situation as a violation of article 2 First Protocol of the
Convention:
Article 2 . Right to education
No person shall be denied the right to education. In the exercise of any functions
which it assumes in relation to education and to teaching, the State shall respect
the right of parents to ensure such education and teaching in conformity with
their own religious and philosophical convictions
