Gastaufnahmevertrag – Regelung zum Vertragsabschluss,Leistungen,vorzeitige
Abreise undRücktritt
Werden zwischen dem Vermieter und dem Gast keine
Stornobedingungen vereinbart, so gelten die nachstehend
angeführten Stornobestimmungen. Als Vereinbarung der
Stornokosten gilt jenach Buchungsart auch die Aufführung
derBedingungen in derPreisliste,auf derInternetseiteund in
weiteren Mediendes Vermieters.
Auszug ausden Stornobestimmungen:
1. Vertragsabschluss: Mit der Bestellung, Buchung, Zusage
oder derkurzfristigen Bereitstellungder Unterkunft und
derdarauffolgendenReservierungsbestätigung kommt ein
Gastaufnahmevertrag zustande, der beide Vertragsparteien
verpflichtet, den Vertrag zu erfüllen, mit all seinen
Rechten und Pflichten, gleichgültig für welche Dauer der
Vertragabgeschlossenwurde.
2. Leistungen: Der Gastaufnahmevertrag ist abgeschlossen,
sobald das Zimmer /die Ferienwohnung bestellt und von
beiden Vertragsparteien mündlich oder schriftlich zugesagt
wurde. Mit Abschluss des Gastaufnahmevertrages verpflichtensich
die Parteien fürdie gesamteDauer desVertrages zur
Erfüllung der folgenden gegenseitigen Verpflichtungen aus
demVertrag:
a.) Der Gastwirt ist verpflichtet, die jeweilige Unterkunft
im nutzungsgerechten Zustand und entsprechend der Bestellungbereitzustellen.
b.) Der Gast ist verpflichtet, das vertraglich geschuldete
Entgelt für die Zeit (Dauer) der Bestellung der Unterkunft
zu entrichten.
c.) Der Gast wird von der Entrichtung des vertraglich geschuldeten
Entgelts nicht dadurch befreit, dass er, unabhängig
vomGrund derVerhinderung,ander Ausübung des
ihmzustehendenGebrauchsrechtes verhindert wird.
d.) Beruht dieVerhinderung jedoch aufeinem Grund, dender
Gastwirt zu vertreten hat, wird der Gast von der Entrichtung
desvertraglich geschuldeten Entgeltsfrei.
3. Vorzeitige Abreise: BeivorzeitigerAbreise gelten,wenn
zwischen dem Vermieter und dem Gast nicht anders vereinbart,
folgende Bestimmungen: Bei vorzeitiger Abreise
(unabhängig davon, ob die Aufenthaltsdauer mündlich oder
schriftlichvereinbartwurde) können die Aufenthaltskosten
(Urlaubspreis minus nicht entstandene Kosten) durch den
Gastwirt eingefordert werden. Das gilt nur für den Fall,
wenn esdem Gastwirt nachweislich nicht gelingt, die Unterkunft
weiterzuvermieten. Sollte es dem Gastwirt nur
für einen Teilzeitraum gelingen, die Unterkunft weiterzuvermieten,
kann er für den restlichen Zeitraum die Aufenthaltskosten
berechnen. Die Aufenthaltkosten werden bei
Zimmer mit Verpflegung pauschal mit 70%des vereinbarten
Preises, bei Ferienwohnung mit 90%des vereinbarten
Preises festgelegt.
4. Rücktritt: Bei Stornierung der Reservierung gelten,
wenn zwischen dem Vermieter und dem Gast nicht anders
vereinbart, folgende Bestimmungen: Bei Stornierung können
die Aufenthaltskosten (Urlaubspreis minus nicht entstandene
Kosten)durchden Gastwirt eingefordert werden.
Das gilt nur für den Fall, wenn esdem Gastwirt nachweislich
nicht gelingt,die Unterkunft weiterzuvermieten. Sollte
es dem Gastwirt nur für einen Teilzeitraum gelingen, die
Unterkunft weiterzuvermieten, kann er für den restlichen
Zeitraum die Aufenthaltskosten berechnen. DieAufenthaltkosten
werdenbei Zimmer mitVerpflegung pauschal mit 70
%des vereinbarten Preises, bei Ferienwohnung mit 90%
desvereinbartenPreises festgelegt.
5. Gerichtsstand: Ausschließlicher Gerichtsstand ist der
Betriebsort.

diannullamento, siapplicheranno leseguenti disposizioni
didisdetta. Le spese diannullamento saranno calcolate
in base al tipo di prenotazione nonché alle condizioniriportate
nellistino prezzi,sul sito Internetesualtri mezzidicomunicazionedell’albergatore.
1. Conclusione del contratto: Il contratto diospitalità è
stipulato con l’ordine, laprenotazione, la conferma oppure
la messa adisposizione abreve termine diunalloggio e
della conseguente conferma della prenotazione edobbliga
entrambe le parti all’adempimento del contratto con tutti
isuoi diritti ed obblighi, indipendentemente dalla durata
delsoggiorno.
2. Prestazioni: Il contratto diospitalità siintende concluso
nelmomento in cuilacameraèstata prenotataeconfermata
da entrambe le parti inmaniera scritta overbale. Con la conclusionedel
contratto, le partisiobbligano perl’interadurata
del contratto all’adempimento dei seguenti obblighi reciprochiprevistidal
contratto:
a) L’albergatore ha l’obbligo difornire ilrispettivo alloggio in
unostato adeguato all’usoeconformeallaprenotazione.
b) L’ospite ha l’obbligo dipagare il corrispettivo previsto dal
contratto per il periodo (durata) della prenotazione dell’alloggio.
c) L’impedimento dell’ospite di esercitare il diritto d’uso alui
spettante, non loesonera dal pagamento del corrispettivo
stabilito dalcontratto,indipendentemente dalmotivodell’impedimento.
d) Qualorainvecel’impedimento si basi su un motivo inerente
all’albergatore,l’ospitesaràesonerato dalpagamento delcorrispettivo
stabilito dalcontratto.
3. Partenza anticipata: Salvoaccordi diversitra le parti, in
caso di partenza anticipatavalgonoleseguenti disposizioni:
in caso di partenza anticipata(indipendentemente dalfatto
cheladuratadel soggiorno siastata concordata periscritto
overbalmente), icosti del soggiorno (quota di soggiorno
meno icosti non sostenuti) dovranno essere corrisposti
dall’ospite. Ciò vale solo per ilcaso incui l’albergatore non
riuscisse adaffittare ad altri l’alloggio. Qualora l’albergatore
riuscisse adaffittare l’alloggio soltanto per unperiodo
ridotto, potrà addebitare all’ospite icosti di soggiorno per
il periodo restante. Icosti del soggiorno in caso di camera
conpensionesarannostabiliti su base forfetaria pari al 70%
delprezzoconcordato; in caso di appartamento di vacanzai
costicorrisponderannoal90% delprezzoconcordato.
4. Recesso: Salvo accordi diversi tra le parti, in caso di annullamento
della prenotazione valgono le seguenti disposizioni:
in caso di annullamento, icosti del soggiorno (quota
di soggiorno meno icosti non sostenuti) dovranno essere
corrispostidall’ospite.Ciò vale solo perilcasoincui l’albergatore
non riuscisse ad affittare ad altri l’alloggio. Qualora
l’albergatore riuscisseadaffittare l’alloggio soltanto perun
periodo ridotto, potrà addebitare all’ospite icosti di soggiorno
per ilperiodo restante. Icosti del soggiorno in caso
di camera con pensione saranno stabiliti su base forfetaria
pari al 70% del prezzo concordato; incaso diappartamento
di vacanza icosti corrisponderanno al90% del prezzo
concordato.
5. Foro competente: Il foro competente esclusivo èquello
dellasededell’esercizio.
CancellationTerms
Vacation accommodation agreement –contract conclusion,
services, early departure and cancellation regulations
Thefollowing cancellationterms shallapplyifnoother terms
are agreed betweenthe accommodationfacility andthe guest.
Depending onthe type of reservation, agreed cancellation
costs include conditions detailed onthe price list, on the
website andinother documentation produced by theaccommodationfacility.
Excerptfromthe cancellationterms:
1. Conclusion ofcontract: With the booking, reservation,
promiseorshort term provisionofaccommodationand the
subsequent confirmation, avacation accommodation contractshallbedeemedtohavecomeintoforce.Thisobliges
both parties tofulfil the agreement, with all its rights and
responsibilities, regardlessofits duration.
2. Services: Avacationaccommodationcontractisdeemed
to have been concludedassoonasthe bookingfor theroom
/holiday home has been made and accepted either verbally
or in writing by both partiestothe contract.Whenthe agreement
is concluded, both partiescommit, forits entire duration,
to fulfil thefollowing mutual responsibilities:
a.) The accommodation facility undertakes to provide the accommodation
inacondition that is fit for purpose and in accordance
with thebooking.
b.) Theguestisobliged to paythe contractually agreed price
forthe time (duration)ofthe reservation.
c.) The guest will not beautomatically released from paying
thesum owing underthe agreement, if,regardlessofthe reasonfor
thehindrance,heisprevented from exercisingthe right
of usetowhich he is entitled.
d.) However, ifthe accommodation facility is responsible
for preventing the guest from exercising this right of use,
the guest shall be released from the requirement to pay the
agreed sum.
3. Earlydeparture: Unless otherwise agreed between the
accommodation facility and the guest, the following terms
shallapplyinthe case of early departure:Inthe case of early
departure by theguest(regardlessofwhether theduration
of the stay was agreed verbally or in writing) the accommodation
expenses (holiday price less costs that were not
incurred) may be claimed by the accommodation facility.
This only appliesifithas been demonstrably impossible for
theaccommodationfacility to re-let theaccommodationto
athird party. Ifthe accommodation facility is only able to
re-let the accommodation toathird party for part ofthe
period, then acharge maybemadefor theremainderofthe
period. Theaccommodationexpensesare setat70% of the
price agreed for the room and board or 90% ofthe price
agreed forthe holidayhome.
4. Cancellation: Unless otherwise agreed between the accommodation
facility and the guest, the following terms
shallapplyincaseofcancellation: In theevent of acancellation,
theaccommodationexpenses(holidayprice lesscosts
not incurred) may bereclaimed by the accommodation
facility. This only appliesifithas been demonstrably impossible
forthe accommodationfacility to re-let theaccommodationtoathirdparty.Ifthe
accommodationfacility is only
able to re-let theaccommodationtoathirdparty forpartof
theperiod, then acharge maybemadefor theremainderof
theperiod. Theaccommodationexpensesare setat70% of
theprice agreed forthe room andboard or 90%ofthe price
agreed forthe holidayhome.
5. Place ofjurisdiction: Sole place ofjurisdiction isthe
placewhere theserviceisprovided.
Conditionsd’annulation
Accord d’hébergement de vacances – conclusion
contractuelle, services, départs prématurés etclause
d’annulation
Sauf accord contraireentre l’établissementd’hébergement et
le visiteur,les conditionsd’annulationsuivantes entrentenvigueur.
Selon le type de réservationeffectué, les coûtsd’annulationconvenusincluentles
dispositionsdétailléessur le tarif,
sur le site internet etsur toute autre documentation fournie
parl’établissement d’hébergement.
Extrait des conditions d’annulation:
1. Conclusion ducontrat: la réservation, la promesse ou
la mise àdisposition d’un hébergement pour une courte
durée etlaconfirmation qui s’ensuit valent conclusion de
contrat d’hébergement. Celui-ci oblige les parties àrespecterlecontrat,les
droits et responsabilitésqui en découlent,
quelle qu’ensoitladurée.
2. Services: un contratd’hébergement estréputéconclu dès
lorsqu’uneréservationdechambre/résidencedevacancesest
effectuée etacceptée verbalement oupar écrit par les deux
partiesaucontrat.Lorsque le contratest conclu,les deux partiess’engagent
àrespecter les obligations mutuelles suivantes,
pour toutesadurée:
a.) L’établissement d’hébergement s’engage àfournir l’hébergement
selon des conditions appropriées aucontexte et
conformesàlaréservation.
b.) Le visiteur s’engage contractuellement àpayer le prix
convenu pour la duréedelaréservation.
c.) Le visiteur ne sera pasautomatiquement dispensé de payer
la sommedue au titre du contrats’ilnepeut pasexercer son
droitd’utilisation, et ce,quellequ’en soit la raison.
d.) Toutefois, si l’établissement d’hébergement est responsable
de cet empêchement, l‘invité sera dispensé del’obligationdepayer
la sommeconvenuecontractuellement.
3. Départs prématurés: sauf clause contraire entre l’établissement
d’hébergement etlevisiteur, les conditions suivantes
s’appliquent en cas dedépart prématuré :encas de
départ prématuré du visiteur (que la duréeduséjourait été
fixée oralement ou par écrit), les frais d‘hébergement (prix
du séjour moins frais non encourus) restent dus àl‘établissement
d‘hébergement. Ceci ne s’appliqueque s‘il estprouvé
que l’établissement d’hébergement n’a pas pure-louer
l’hébergementàuntiers. Si l’établissementd’hébergement
n’a pure-louer l‘hébergement àuntiers que pour une partiedelapériode,des
fraisproportionnelsaureste de ladite
périodeserontfacturés. Lesfrais d’hébergementsontfixés
à70%dutarif convenu pour les chambres et la pensionou
90 %dutarif convenu pour les résidences.
4. Annulation: sauf clause contraire entre l’établissement
d’hébergement et le visiteur, les conditions suivantes
s’appliquent en cas d’annulation :encas d’annulation, les
frais d’hébergement (prix duséjour moins frais non encourus)
restent dus àl’établissement d’hébergement. Ceci
ne s’applique que s‘il est prouvé que l’établissement d’hébergement
n’a pas pure-louer l’hébergement àuntiers. Si
l’établissement d’hébergement n’a pure-louer l‘hébergement
àuntiersque pour unepartiedelapériode,des frais
proportionnels aureste de ladite période seront facturés.
Les frais d’hébergement sont fixés à70%dutarif convenu
pour les chambres et la pension ou90%dutarif convenu
pour les résidences.
5. Juridiction: La seule juridiction valide est le lieu où le
serviceest rendu.
