9. Action by Commanding Officer<br />

a. When the investigation results in a<br />

determination of Unfounded,Exonerated.<br />

or Not Sustained, the Commanding Officer<br />

will so notify the accused person.<br />

informing him that the determination<br />

is subj ect to review, and continue<br />

him on duty. Should be have<br />

been excused from duty. he will be<br />

paid for this period of time as though<br />

he had worked.<br />

b. When the allegation is Sustained, and<br />

also when the investigation is to be<br />

continued (see paragraph 8-g). the<br />

Commanding Officer will take one of<br />

the following actions in reference to<br />

the duty status of the accused person:<br />

(1) Continue him on duty in his usual<br />

assignment.<br />

(2) Continue him on duty in some other<br />

assignment where (a) his presence<br />

will not be objectionable to<br />

citizens involved in the incident,<br />

or (b) he may be kept under<br />

closer supervision. such as at<br />

station tasks.<br />

(3) When the act <strong>com</strong>plained of is immoral,<br />

indecent, or brutal. or<br />

involves the actual or threatened<br />

physical mistreatment of another<br />

person. or when the accused person<br />

has been drinking, he will be<br />

excused from duty until further<br />

notice.<br />

(4) When the act <strong>com</strong>plained of is a<br />

crime and the evidence is such<br />
