9. Action by Commanding Officer
a. When the investigation results in a
determination of Unfounded,Exonerated.
or Not Sustained, the Commanding Officer
will so notify the accused person.
informing him that the determination
is subj ect to review, and continue
him on duty. Should be have
been excused from duty. he will be
paid for this period of time as though
he had worked.
b. When the allegation is Sustained, and
also when the investigation is to be
continued (see paragraph 8-g). the
Commanding Officer will take one of
the following actions in reference to
the duty status of the accused person:
(1) Continue him on duty in his usual
assignment.
(2) Continue him on duty in some other
assignment where (a) his presence
will not be objectionable to
citizens involved in the incident,
or (b) he may be kept under
closer supervision. such as at
station tasks.
(3) When the act complained of is immoral,
indecent, or brutal. or
involves the actual or threatened
physical mistreatment of another
person. or when the accused person
has been drinking, he will be
excused from duty until further
notice.
(4) When the act complained of is a
