(d) The individual or the individual's legal representative may request<br />

an expedited hearing if the individual or the individual's legal<br />

representative feels that there is immediate, serious threat to the<br />

individual's life or health should the normal timing of the hearing<br />

process be followed.<br />

(e) If the individual or the individual's legal representative requests a<br />

hearing be<strong>for</strong>e the effective date of the proposed action and requests<br />

that the existing services be continued, <strong>DHS</strong> shall continue the<br />

services.<br />

(A) <strong>DHS</strong> must continue the services until whichever of the<br />

following occurs first:<br />

(i) The current authorization expires;<br />

(ii) The administrative law judge issues a proposed order<br />

and <strong>DHS</strong> issues a final order; or<br />

(iii) The individual is no longer eligible <strong>for</strong> Medicaid<br />

benefits.<br />

(B) <strong>DHS</strong> must notify the individual or the individual's legal<br />

representative that <strong>DHS</strong> is continuing the service. The notice<br />

must in<strong>for</strong>m the individual or the individual's legal<br />

representative that, if the hearing is resolved against the<br />

individual, <strong>DHS</strong> may recover the cost of any services continued<br />

after the effective date of the continuation notice.<br />

(f) <strong>DHS</strong> may reinstate services if:<br />

(A) <strong>DHS</strong> takes an action <strong>with</strong>out providing the required notice<br />

and the individual or the individual's legal representative<br />

requests a hearing;<br />

(B) <strong>DHS</strong> fails to provide the notice in the time required in this<br />

rule and the individual or the individual's legal representative<br />

requests a hearing <strong>with</strong>in 10 days of the mailing of the notice of<br />

action; or<br />
