(b) An individual in emergent status may receive crisis diversion<br />

services that may cause an individual’s benefit level to be exceeded.<br />

(A) Use of crisis diversion services and length of emergent<br />

status may be authorized only by the CDDP of the individual's<br />

county of residence, or the Regional Crisis Diversion Program<br />

responsible <strong>for</strong> the individual's county of residence, depending<br />

on the source of the funds <strong>for</strong> crisis diversion services.<br />

(B) Funds associated <strong>with</strong> crisis diversion services may be<br />

used to pay the difference in cost between the authorized ISP<br />

and the supports authorized by either the CDDP of the<br />

individual's county of residence or the Regional Crisis Diversion<br />

Program responsible <strong>for</strong> crisis diversion services in the<br />

individual's county of residence, depending on the source of<br />

crisis diversion services funds required to meet the short-term<br />

need.<br />

(C) Although costs <strong>for</strong> crisis diversion services may bring the<br />

individual's total plan year cost temporarily above the individual<br />

cost limit, the individual's costs may not exceed the cost of the<br />

state's current ICF/MR daily cost per individual nor shall plan<br />

year expenses at or above the individual cost limit make the<br />

individual eligible <strong>for</strong> comprehensive services.<br />

(D) Individuals placed in emergent status due to receiving crisis<br />

diversion services authorized and provided according to OAR<br />

411-320-0160 may remain enrolled in, and receive support<br />

services from, the brokerage while both crisis diversion services<br />

and support services are required to stabilize and maintain the<br />

individual at <strong>home</strong> or in the family <strong>home</strong>.<br />

(c) Individuals whose source of support funds are, in whole or in part,<br />

an individual-specific redirection of funds through a Department<br />

contract from a Department-regulated residential, work, or day<br />

habilitation service to support services funds, or to comprehensive in<strong>home</strong><br />

support funds regulated by OAR chapter 411, division 330 prior<br />

to entry to a brokerage, may have access to the amount specified in<br />

the Department contract as available <strong>for</strong> the individual's use. This<br />

provision is only applicable when each transition is separate and<br />
