(J) Failed to comply <strong>with</strong> the provisions of OAR 411-340-<br />
0130(8) of this rule or OAR 411-340-0140; or<br />
(K) Been suspended or terminated as a provider by another<br />
division <strong>with</strong>in the Department or Oregon Health Authority.<br />
(b) The following sanctions may be imposed on a provider:<br />
(A) The provider may no longer be paid <strong>with</strong> support services<br />
funds;<br />
(B) The provider may not be allowed to provide services <strong>for</strong> a<br />
specified length of time or until specified conditions <strong>for</strong><br />
reinstatement are met and approved by the brokerage or the<br />
Department, as applicable; or<br />
(C) The brokerage may <strong>with</strong>hold payments to the provider.<br />
(c) If the brokerage makes a decision to sanction a provider, the<br />
brokerage must notify the provider by mail of the intent to sanction.<br />
(d) The provider may appeal a sanction <strong>with</strong>in 30 days of the date the<br />
sanction notice was mailed to the provider. The provider must appeal<br />
a sanction separately from any appeal of audit findings and<br />
overpayments.<br />
(A) A provider of Medicaid services may appeal a sanction by<br />
requesting an administrative review by the Department's<br />
Administrator.<br />
(B) For an appeal regarding provision of Medicaid services to<br />
be valid, written notice of the appeal must be received by the<br />
Department <strong>with</strong>in 30 days of the date the sanction notice was<br />
mailed to the provider.<br />
(e) At the discretion of the Department, providers who have<br />
previously been terminated or suspended by any Department division<br />
or by the Oregon Health Authority may not be authorized as providers<br />
of Medicaid services.<br />
