(i) When equipment is obtained <strong>for</strong> the exclusive use of<br />
an individual, the brokerage must record the purpose,<br />
final cost, and date of receipt.<br />
(ii) The brokerage must secure use of equipment or<br />
furnishings costing more than $500 through a written<br />
agreement between the brokerage and the individual or<br />
the individual's legal representative that specifies the time<br />
period the item is to be available to the individual and the<br />
responsibilities of all parties should the item be lost,<br />
damaged, or sold <strong>with</strong>in that time period.<br />
(iii) The brokerage must ensure that projects <strong>for</strong><br />
environmental accessibility adaptations involving<br />
renovation or new construction in an individual's <strong>home</strong><br />
costing $5,000 or more per single instance or<br />
cumulatively over several modifications:<br />
(I) Are approved by the Department be<strong>for</strong>e work<br />
begins and be<strong>for</strong>e final payment is made;<br />
(II) Are completed or supervised by a contractor<br />
licensed and bonded in Oregon; and<br />
(III) That steps are taken as prescribed by the<br />
Department <strong>for</strong> protection of the Department's<br />
interest through liens or other legally available<br />
means.<br />
(iv) The brokerage must obtain written authorization from<br />
the owner of a rental structure be<strong>for</strong>e any environmental<br />
accessibility adaptations are made to that structure.<br />
(b) Any goods purchased <strong>with</strong> support services funds that are not<br />
used according to an ISP or according to an agreement securing the<br />
state's use may be immediately recovered. Failure to furnish written<br />
documentation upon written request from the Department, the<br />
Oregon Department of Justice Medicaid Fraud Unit, Centers <strong>for</strong><br />
Medicare and Medicaid <strong>Services</strong>, or their authorized representatives<br />
