(e) In accordance <strong>with</strong> Oregon Board of Nursing rules in OAR chapter<br />

851 when services involve per<strong>for</strong>mance of nursing services or<br />

delegation, teaching, and assignment of nursing tasks;<br />

(f) In accordance <strong>with</strong> OAR 411-340-0160 through 411-340-0180<br />

governing provider qualifications and responsibilities; and<br />

(g) In accordance <strong>with</strong> the Department's <strong>Support</strong> <strong>Services</strong><br />

Expenditure Guidelines.<br />

(8) INDEPENDENT PROVIDER, PROVIDER ORGANIZATION, AND<br />

GENERAL BUSINESS PROVIDER AGREEMENTS AND<br />

RESPONSIBILITIES. When support services funds are used to purchase<br />

services, training, supervision, or other personal assistance <strong>for</strong> individuals,<br />

the brokerage must require and document that providers are in<strong>for</strong>med of:<br />

(a) Mandatory reporter responsibility to report suspected abuse;<br />

(b) Responsibility to immediately notify the person or persons, if any,<br />

specified by the individual or the individual's legal representative of<br />

any injury, illness, accident, or unusual circumstance that occurs<br />

when the provider is providing individual services, training, or<br />

supervision that may have a serious effect on the health, safety,<br />

physical or emotional well-being, or level of services required;<br />

(c) Limits of payment:<br />

(A) <strong>Support</strong> services fund payments <strong>for</strong> the agreed-upon<br />

services are considered full payment and the provider under no<br />

circumstances may demand or receive additional payment <strong>for</strong><br />

these services from the individual, the individual’s family, or any<br />

other source unless the payment is a financial responsibility<br />

(spend-down) of an individual under the Medically Needy<br />

Program; and<br />

(B) The provider must bill all third party resources be<strong>for</strong>e using<br />

support services funds unless another arrangement is agreed<br />

upon by the brokerage and described in the ISP.<br />
