(C) <strong>Support</strong> services funds are not expended to such an extent<br />

that the support services funds that may be required to<br />

purchase the remainder of necessary supports following the<br />

termination of crisis diversion services shall be unavailable; and<br />

(D) <strong>Support</strong> services funds are used <strong>for</strong> no more than 90 days<br />

following the determination that the individual shall enter a<br />

comprehensive service.<br />

(d) The ISP projects the amount of support services funds, if any, that<br />

may be required to purchase the remainder of necessary supports<br />

that are <strong>with</strong>in the benefit level; and<br />

(e) The ISP has been authorized <strong>for</strong> implementation.<br />

(2) Goods and services purchased <strong>with</strong> support services funds on behalf of<br />

individuals are provided only as social benefits.<br />

(3) LIMITS OF FINANCIAL ASSISTANCE. The use of support services<br />

funds to purchase individual supports in any plan year is limited to the<br />

individual's annual benefit level.<br />

(a) Individuals must have access throughout the plan year to the total<br />

annual amount of support services funds <strong>for</strong> which they are eligible<br />

that are determined to be necessary to implement an authorized ISP,<br />

even if there is a delay in implementation of the ISP, unless otherwise<br />

agreed to in writing by the individual or the individual's legal<br />

representative.<br />

(b) The Department may require that annual benefit level amounts be<br />

calculated and applied on a monthly basis when an individual's<br />

eligibility <strong>for</strong> Medicaid changes during a plan year, an individual's<br />

benefit level changes, or when an individual's ISP is developed and<br />

written to be in effect <strong>for</strong> less than 12 months.<br />

(A) Except in the case of an individual whose benefit level<br />

changes as the result of a change in eligibility <strong>for</strong> the <strong>Support</strong><br />

<strong>Services</strong> Waiver, when an individual's benefit level changes,<br />

the monthly benefit level shall be 1/12 of the annual benefit<br />
