specific to the individual and the services being converted are not<br />
subject to statewide service transitions.<br />
(A) Individual plan year costs must always be less than the<br />
individual cost limit; and<br />
(B) The brokerage must review the need <strong>for</strong> supports and their<br />
cost-effectiveness <strong>with</strong> the individual and the individual's legal<br />
representative at least annually and must make budget<br />
reductions when allowed by the ISP.<br />
(d) Individuals whose support funds were specifically assigned<br />
through a Department contract to self-directed support services prior<br />
to the date designated by the Department <strong>for</strong> transfer of the individual<br />
from self-directed support services to a brokerage may have access<br />
to the amount specified in the Department contract as available <strong>for</strong><br />
the individual's use.<br />

(B) The brokerage must review the need <strong>for</strong> supports and their<br />
cost-effectiveness <strong>with</strong> the individual and the individual's legal<br />
representative at least annually and must make budget<br />
reductions when allowed by the ISP.<br />
(e) Individuals transferring from the Department's Home and<br />
Community-Based Waiver <strong>Services</strong> <strong>for</strong> the Aged and <strong>Adults</strong> <strong>with</strong><br />
Physical Disabilities who have been determined ineligible <strong>for</strong> those<br />
waiver service funds in accordance <strong>with</strong> OAR 411-015-0015(4)(c),<br />
shall have limited access to support services funds as described in<br />
these rules. The amount of support services funds available shall be<br />
equal to the Department's previous service costs <strong>for</strong> the individual <strong>for</strong><br />
no more than 365 calendar days. The 365 calendar days begins the<br />
date the individual starts receiving support services exclusively<br />
through a brokerage.<br />
(f) For Medicaid recipients eligible <strong>for</strong> and choosing services under<br />
the <strong>Support</strong> <strong>Services</strong> Waiver, individuals may have access to a basic<br />
