Procedures leading to the award of a<br />
Public Contract<br />
Prior Information Notice (PIN) – This is voluntary<br />
and often used to stimulate market interest and allow<br />
bidders to prepare themselves to Bid in time. It can<br />
also enable reduced timescales for competition.<br />
There are Four Award Procedures available:<br />
Open Procedure: A tender is placed with the<br />
OJEU. This tender is open to any party in the EU. No<br />
party shall be excluded from tender. Using an open<br />
procedure means that the Invitation to Tender must<br />
be sent to all suppliers that express an interest in the<br />
Contract Notice. This procedure is most appropriate<br />
when there are a small number of suppliers expected<br />
to request an Invitation to Tender.<br />
Restricted Procedure: A restricted procedure<br />
is appropriate when many suppliers exist within a<br />
market and it is not feasible to issue an Invitation to<br />
Tender to each.<br />
Negotiated Procedure: The Negotiated Procedure<br />
allows Institutions to negotiate directly with suppliers<br />
in order to award a contract. It is a procedure which<br />
should only be used in limited circumstances, for<br />
example in cases of extreme urgency or when an<br />
open or restricted procedure has been discontinued.<br />
Competitive Dialogue Procedure: This can only<br />
be used in circumstances for ‘particularly complex’<br />
procurements where it would not be possible to award<br />
a contract using the open or restricted procedures<br />
and where the circumstances do not permit use of<br />
negotiated procedures. This is where an Awarding<br />
Authority is not objectively able to define the technical<br />
means capable of satisfying its needs or objectives; or,<br />
specify either the legal or financial make-up of a project,<br />
or both;<br />
Accelerated Procedures<br />
<br />
Negotiated Procedure with a call for competition where<br />
urgency makes the normal timescale impractical. It<br />
does not alter the processes of the procedure, but<br />
it does reduce the timescales: the normal time limits<br />
of 37 days to express an interest can be reduced to<br />
15 days. The time limit for the receipt of tenders in<br />
a Restricted Procedure competition can be reduced<br />
from 40 to 10 days. The maximum time for request of<br />
documents from 6 to 4 days.<br />
