in 1993, Lee County withdrew its participation in the development application, prompting a lawsuit by the private developer. Private developer claims a breach <strong>of</strong> contract as the<br />
cause <strong>of</strong> action. The DRI will never be developed as originally stated within the application, however, a non-DRI marina facility exists onsite.<br />
During the development order review period, the Lee County Board <strong>of</strong> County Commissioners decided to withdraw from the DRI process. The marina owner then sued the County for<br />
a breach <strong>of</strong> contract.<br />
