Ramona Hog Lake Road Improvement Project August 2011 The Porter-Cologne Water-Quality Act, as amended in 2006 - The Porter-Cologne Act, (as amended in 2006), is included in the California Water Code. This act provides for the protection of water quality by the State Water Resources Board and the Regional Water Quality Control Boards, which are authorized by the US Environmental Protection Agency (US EPA) to enforce the Clean Water Act of California. Section 13263 of the Porter Cologne Act requires compliance with the Provisions of the Federal Water Pollution control Act as amended in 1972 (also known as the CWA) and preparation of a Pollution Prevention Plan for all projects. Direction relevant to the proposed action as it affects soil resources includes: San Bernardino National Forest Land Management Plan - The Soil and Watershed Program cooperates with various water agencies and other national forest functional areas to reduce erosion and maintain high quality water for various users and natural resources through application of Best Management Practices in all Forest Service activities (WAT 1 – Watershed Function) (LMP, Part 2, pg. 27,pg. 136) Forest Service Handbook (FSH), (supplemental to the LMP) 2509.22 Chapter 3.21 – Stream Protection Measures General to all management activities: 1. all applicable best management practices (BMPs) (USDA forest service 2000) should be identified and followed in all ground disturbing forest management actions, including all contracts, operating plans, and work orders. Chapter 3.30 - Road Construction and Maintenance: 4. New culverts, bridges and other stream crossing structures should be designed to accommodate at least a 50-year flood event, including associated bed load and debris movement (page 19 and 20 of 33). National Forest Management Act of 1976 - Renewable Resource Program. “recognize the fundamental need to protect and where appropriate, improve the quality of soil, water and air resources.” Compliance with the Forest Plan and Other Direction San Bernardino National Forest Plan (2006) Forest Wide Standards and Guidelines, Strategies and Tactics (LMP, Part 2, Appendix B, pp. 134-136). The Proposed Action is consistent with the Forest Plan if mitigation measures / design criteria are implemented. Best Management Practices to incorporate into design criteria Reference: USDA Forest Service, 2000, Water Quality Management for Forest System Lands in California: Best Management Practices, Pacific Southwest Region. “Pursuant to Section 208 of the Clean Water Act, all agencies responsible for carrying out any portion of a State Water Quality Management Plan must be designated as a Water Quality Management Agency (WQMA). Ramona Hog Lake Road Improvement Project August 2011 Service in 1981, the SWRCB designated the Forest Service (USFS) as the WQMA for NFS lands in California (See Section 14).” Erosion Control Plan (PRACTICE: 2-2) - To limit and mitigate erosion and sedimentation through effective planning prior to initiation of construction activities and through effective contract administration during construction. The detailed mitigations are reflected in the contract specifications and provisions. The intent of mitigation is to prevent construction-generated erosion, as well as that generated from the completed road, from entering watercourses. Following the decision, the Forest Hydrologist will incorporate all appropriate and applicable BMPs into the Erosion Control Plan and be included in pre-construction meetings with the contractor and proponent to describe the required BMPs. Timing of Construction Activities (PRACTICE: 2-3) - To minimize erosion by conducting operations during minimal runoff periods. Construction of drainage facilities and performance of other contract work to control erosion and sedimentation will be required in conjunction with earthwork projects. The operator should limit the amount of area being graded at a site at any one time, and should minimize the time that an area is laid bare. Erosion control work must be kept current when road construction occurs outside of the normal operating season. Stabilization of Road Slope Surfaces and Spoil Disposal Areas (PRACTICE: 2- 4) - To minimize erosion from exposed cut slopes, fill slopes, and spoil disposal areas. Depending on site factors such as slope angle, soil type, climate, and proximity to waterways, many fill slopes, some cut slopes, and some spoil disposal areas will require vegetative and/or mechanical measures to provide surface soil stability. Road Slope Stabilization Construction Practices (PRACTICE: 2-5) - To reduce sedimentation by minimizing erosion from road slopes and slope failure along roads. Plan all road construction considering adequate stabilization needs. The first planning requirement is an adequate soils and geologic investigation, to provide data necessary for proper cut and fill design. Control of Road Drainage (PRACTICE: 2-7) - Objective: Is to minimize the erosive effects of water concentrated by road drainage features; to disperse runoff from disturbances within the road clearing limits; to lessen the sediment yield from roaded areas; to minimize erosion of the road prism by runoff from road surfaces and from uphill areas. Timely Erosion Control Measures on Incomplete Roads and Stream Crossing Projects (PRACTICE: 2-9) - The best drainage design can be ineffective if erosion control has not been completed by the end of the normal operating season. Apply protective measures to all areas of disturbed, erosion-prone, unprotected ground that is not to be further disturbed in the present year. When conditions permit operations outside of the normal operating season, update the operating plan as necessary and keep erosion control measures sufficiently current with ground Frank Springer & Associates, Inc.
