PRECIS
This report considers a development application for a boundary adjustment between two
existing rural allotments including a SEPP 1 objection to Clause 15 of the Hastings Local
Environmental Plan 2001 at Lot 1 DP 1131887 and Lot 73 DP 754412, Wallis Road,
Ellenborough.
The application is being reported to full Council in accordance with the NSW Department of
Planning's Circular PS 08-014.
The application was considered by Council's Development Assessment Panel on 19
January 2011 and the following recommendation was made:
"That DA 2010/0507 for a boundary adjustment including a SEPP 1 objection to Clause 15
of the Hastings Local Environmental Plan 2001 at Lot 1, DP 1131887 and Lot 73, DP
754412, Wallis Road, Ellenborough, be supported and it be recommended to Council that
the application be determined by granting conditional consent.
with the following changes to conditions of consent:
B(1) delete the words "...(including street lighting where required)...."
B(4) insert the words after ...Restriction as to User...."in favour of Port Macquarie-Hastings
Council".
RECOMMENDATION
That DA 2010/0507 for a boundary adjustment including a SEPP 1 objection to
Clause 15 of the Hastings Local Environmental Plan 2001 at Lot 1, DP 1131887 and
Lot 73, DP 754412, Wallis Road, Ellenborough, be determined by granting consent
subject to the recommended conditions.
