Subject WORKS IN KIND APPLICATION - ROADWORKS,
STREETSCAPE WORKS AND CONSTRUCTION OF LANEWAY,
GORE AND BRIDGE STREETS, PORT MACQUARIE

This report recommends the acceptance of an offer to undertake works as Material Public Benefit
at the intersection of Gore and Bridge Streets and construction of the laneway from Gore Street to
the Bridge Street public car park.
RECOMMENDATION
1. That the application to undertake works as Material Public Benefit including the
construction of a roadworks and streetscape works at the intersection of Bridge
and Gore Streets, Port Macquarie and construction of the laneway from Gore Street
to the Bridge Street public car park be accepted subject to the completion of a
Works In Kind Contract, on the basis that the works will provide a material public
benefit pursuant to s94(5)(b) of the Environmental Planning and Assessment Act.
2. The General Manager be grant delegated authority to sign the Works In Kind
Contract on behalf of Council.
Discussion
Hopkins Consultants on behalf of East West Business Group Pty Ltd have applied to carry out
work as Material Public Benefit in lieu of the payment of development contributions for car
parking in association with an approved Health Services Facility and Refreshment Room (DA
2009/0443) at the corner of Bridge and Gore Streets, Port Macquarie.
The development consent requires the payment of Development Contributions in accordance
with Hastings Contribution Plan 1993 Part C – Car Parking and the Hastings Administration
Levy Contributions Plan to address a shortfall of 19 car parking spaces to serve the
development.
The consent also requires the developer to undertake construction of; the unformed laneway
abutting the southern boundary of the development, works adjacent to the subject site at the
south western corner of the intersection including kerb and footpath works and construction of
on street parking along the Bridge and Gore Street frontages.
In addition to these works, the developer has offered to undertake construction of kerb and
footpath works at the north west, north east and south east corners of the intersection of Bridge
and Gore Streets in lieu of payment of parking contributions required by the development
consent. These works, including the laneway from Gore Street to the public car park, are
consistent with Council’s future plan for intersection works, concept future streetscape works
and proposed kerbing and footpath works in the vicinity of the subject site.
