• Proposed offsets of a specified percentage against specified monetary Development
Contributions, in consideration of the works carried out by the Developer including
intersection works, water supply and sewerage works.
• The Landowner to provide the Council with security to secure the performance of
obligations under the agreement.
The draft planning agreement was exhibited in conjunction with the planning proposal for Stage
1A land at Lake Cathie. There were no submissions received in relation to the planning
agreement.
The proposed planning agreement would revoke the previous planning agreement on the date
from which the new planning agreement commences.
Alignment With Strategic Direction
The proposed planning agreement aligns with Council's strategic direction by giving due
consideration to the provision of infrastructure to serve the proposed manufactured housing
estate or to serve development that may be permissible subject to a rezoning of the land having
taken effect.
Consultation
Council's Manager Technical Services, Water Supply Investigation Engineer, Acting Manager
Sewer and Strategic Planner have been consulted as part of the preparation of the draft
planning agreement.
Planning and Policy Impact
The proposed planning agreement addresses the provision of infrastructure required to serve
the proposed development and future rezoning of the land for urban purposes.
Financial & Economic Implications
The contributions offered under the planning agreement are proposed to address the provision
of infrastructure required to serve the proposed development.
Options
Council can resolve to proceed with the recommendation to delegate authority to the General
Manager or not proceed with the granting of delegation.
