prov<strong>is</strong>ions are also <strong>in</strong>cluded. 319 Dur<strong>in</strong>g a state of emergency the rights of all men and<br />

women can be subjected to derogations from the state <strong>in</strong>clud<strong>in</strong>g the enjoyment of all<br />

civil and political rights set forth <strong>in</strong> the present Convention. 320 The right to<br />

derogations <strong>in</strong> a time of emergency must not be <strong>in</strong>cons<strong>is</strong>tent with other obligations <strong>in</strong><br />

<strong>in</strong>ternational <strong>law</strong>. However these rules are outl<strong>in</strong>ed under Articles 4 and 5 of the<br />

Covenant and therefore could be argued as derogable rights under th<strong>is</strong> convention.<br />

Th<strong>is</strong> <strong>in</strong>cludes the right to d<strong>is</strong>crim<strong>in</strong>ate 321 or any activity that aims at the destruction of<br />

any of the rights and freedoms recognized <strong>in</strong> th<strong>is</strong> Convention or at their limitations to<br />

a greater extent than <strong>is</strong> provided for <strong>in</strong> the present Covenant. 322<br />

Dur<strong>in</strong>g the state of emergency the right to liberty and security of the person 323 <strong>is</strong><br />

underm<strong>in</strong>ed and can be derogated from, <strong>in</strong>clud<strong>in</strong>g arbitrary arrest and detention. The<br />

state does not need to <strong>in</strong>form the person at the time of arrest of the reasons for h<strong>is</strong>/her<br />

arrest or the charges aga<strong>in</strong>st them. 324 The state does not have to br<strong>in</strong>g the person<br />

arrested before the Court or a judge or other officer; he/she does not have the right to<br />

a fair trial or to be brought before the court with<strong>in</strong> a reasonable time or released<br />

with<strong>in</strong> a reasonable time. He/she does not have the right to a <strong>law</strong>ful arrest or<br />

detention and could be deprived of liberty and subjected to d<strong>is</strong>respect for the <strong>in</strong>herent<br />

dignity of the person. Juveniles would not be protected from be<strong>in</strong>g thrown <strong>in</strong>to the<br />

same pr<strong>is</strong>ons as adults; their treatment by the state could be the same as that given to<br />

adults. The state does not need to consider the rehabilitation or reformation of<br />

juveniles dur<strong>in</strong>g the state of emergency period and does not have to accord treatment<br />

to their age or legal status. 325 All these rights may be derogated from with<strong>in</strong> the<br />

framework of the state of emergency.<br />

Furthermore liberty of movement can be restricted and the freedom to choose one’s<br />

own residence could be taken away. 326 The state can refuse to allow people to leave<br />

the country <strong>in</strong>clud<strong>in</strong>g h<strong>is</strong> or her own country. These rights are not supposed to be<br />
