<strong>in</strong>stitutions. 340 It says that <strong>in</strong>ternal conflict and unrest that do not constitute a grave<br />
and imm<strong>in</strong>ent threat to the life of the nation cannot justify derogations under Article<br />
4. The Human Rights Council also provides further research: <strong>in</strong> a general comment,<br />
they notioned that, “not every d<strong>is</strong>turbance or catastrophe qualifies as a public<br />
emergency” 341 and that the state of emergency could <strong>in</strong>clude “natural catastrophes, a<br />
mass demonstration, <strong>in</strong>stances of violence and major <strong>in</strong>cidence”. The Geneva<br />
Academy on International Humanitarian and Human Rights <strong>law</strong> adds to th<strong>is</strong> “civil<br />
war and other cases of serious, violent <strong>in</strong>ternal arrest are by far the reasons most<br />
asserted for declar<strong>in</strong>g a state of emergency”. 342 The Lawless v. Ireland case also<br />
re<strong>in</strong>forces the exceptional situation of a cr<strong>is</strong><strong>is</strong>’ as a condition for a state of emergency,<br />
add<strong>in</strong>g that it must affect the ‘whole population and constitute a threat to organized<br />
life’. 343 Another example of exceptional circumstances can be found under the A and<br />
others v. United K<strong>in</strong>gdom case (2009) whereby the court notioned that the attacks on 9/11<br />
<strong>in</strong> New York city and terror<strong>is</strong>m attacks of th<strong>is</strong> nature constitute an emergency<br />
situation threaten<strong>in</strong>g the life of the nation. 344<br />
Secondly the state must <strong>in</strong>form all other parties to the derogations that may take place<br />
through the Secretary-General. The Siracusa Pr<strong>in</strong>ciples outl<strong>in</strong>ed that th<strong>is</strong> official<br />
proclamation must be for the ex<strong>is</strong>tence of the public emergency threaten<strong>in</strong>g the life of<br />
the nation 345 and national <strong>law</strong> changes must follow. 346 The notification to the<br />
Secretary-General and all other parties must conta<strong>in</strong> sufficient <strong>in</strong>formation to permit<br />
state parties to exerc<strong>is</strong>e their rights and d<strong>is</strong>charge their obligations under the<br />
Covenant.<br />
These <strong>in</strong>clude (a) the prov<strong>is</strong>ions from which it has derogated or from which it <strong>in</strong>tends<br />
to derogate, (b) the proclamation of the emergency <strong>in</strong>clud<strong>in</strong>g the constitutional<br />
prov<strong>is</strong>ions, leg<strong>is</strong>lation or decrees govern<strong>in</strong>g the state of emergency, (c) the date of the<br />
