WHICH INTERNATIONAL LAWS, (CONVENTIONS, TREATIES OR<br />
STATUTES) BEST EXPLAIN AND DEFINE CRIMES AGAINST HUMANITY,<br />
WAR CRIMES, ETHNIC CLEANSING AND GENOCIDE?<br />
Although the Rome Statute of the International Crim<strong>in</strong>al Court (2002) <strong>is</strong> not yet considered<br />
customary it does def<strong>in</strong>e and add to the debates on def<strong>in</strong>itions of grave crimes aga<strong>in</strong>st<br />
humanity. In th<strong>is</strong> light it will be analyzed for its descriptive use. The jur<strong>is</strong>diction of the<br />
International Crim<strong>in</strong>al Court <strong>is</strong> limited to the most serious crimes of concern to the<br />
<strong>in</strong>ternational community as a whole. 198 The Court has jur<strong>is</strong>diction <strong>in</strong> accordance with<br />
the Statute and <strong>in</strong> respect only to the follow<strong>in</strong>g crimes; the crime of genocide, crimes<br />
aga<strong>in</strong>st humanity, war crimes and the crime of aggression. Article 7 describes crimes<br />
aga<strong>in</strong>st humanity as acts committed as part of a widespread or systematic attack<br />
aga<strong>in</strong>st any civilian population. Th<strong>is</strong> <strong>in</strong>cludes murder, exterm<strong>in</strong>ation, 199<br />
enslavement, 200 deportation or forcible transfer 201 of population, impr<strong>is</strong>onment or<br />
other severe deprivation of physical liberty <strong>in</strong> violation of fundamental rules of<br />
<strong>in</strong>ternational <strong>law</strong>, as well as torture, 202 rape, sexual slavery, enforced prostitution,<br />
forced pregnancy, enforced sterilization or any other form of sexual violation of<br />
comparable gravity. It also <strong>in</strong>cludes persecution aga<strong>in</strong>st any identifiable group<br />
collectively on political, racial, national, ethnic, cultural, and religious, gender or other<br />
grounds that are universally recognized as imperm<strong>is</strong>sible under <strong>in</strong>ternational <strong>law</strong>. The<br />
crime of apartheid <strong>is</strong> <strong>in</strong>cluded as well as any other <strong>in</strong>humane act of a similar character<br />
<strong>in</strong>tentionally caus<strong>in</strong>g great suffer<strong>in</strong>g or serious <strong>in</strong>jury to body, mental or physical<br />
health. The statute <strong>is</strong> broad and covers all areas of <strong>R2P</strong> descriptions. The next section<br />
covers the crimes <strong>in</strong>dividually.<br />
