<strong>in</strong>ternational <strong>law</strong>. Secondly, Article 3 declares every state has the duty to refra<strong>in</strong> from<br />

<strong>in</strong>tervention <strong>in</strong> <strong>in</strong>ternal or external affairs of another state, emphasiz<strong>in</strong>g the United<br />

Nations Charter, Chapter I, Article 4:<br />

“All members shall refra<strong>in</strong> <strong>in</strong> their <strong>in</strong>ternational relations from the threat or<br />

use of force aga<strong>in</strong>st the territorial <strong>in</strong>tegrity or political <strong>in</strong>dependence of any<br />

state or <strong>in</strong> any other manner <strong>in</strong>cons<strong>is</strong>tent with the purposes of the United<br />

Nations”.<br />

Article 6 of the Draft Declaration on Rights and Duties of States (1949) declares that<br />

every state has the duty to treat all persons under its jur<strong>is</strong>diction with respect for<br />

human rights and fundamental freedoms, without d<strong>is</strong>t<strong>in</strong>ction as to race, sex, language<br />

and religion. Reiterat<strong>in</strong>g the preamble of the Charter of the United Nations,<br />

‘We the peoples … reaffirm faith <strong>in</strong> fundamental human rights <strong>in</strong> the dignity<br />

and worth of the human person, <strong>in</strong> the equal rights of men and women and of<br />

nations large and small’. 48<br />

Article 7 of the draft declaration on Rights and Duties of States (1949) declares every<br />

state has the duty to ensure that conditions prevail<strong>in</strong>g <strong>in</strong> its territory do not menace<br />

<strong>in</strong>ternational peace and order. <strong>R2P</strong> describes prevention and protection of civilians as<br />

the duty to protect civilians from harm th<strong>is</strong> duty firstly rema<strong>in</strong>s with the state. 49<br />

Article 9 declares that every state has the duty to refra<strong>in</strong> from resort<strong>in</strong>g to war as an<br />

<strong>in</strong>strument of national policy and to refra<strong>in</strong> from the threat or use of force aga<strong>in</strong>st<br />

territorial <strong>in</strong>tegrity or political <strong>in</strong>dependence or <strong>in</strong> any other manner <strong>in</strong>cons<strong>is</strong>tent with<br />

<strong>in</strong>ternational <strong>law</strong> and order. Once aga<strong>in</strong> reiterat<strong>in</strong>g the Charter under Article 2 (4).<br />

Article 10 that declares that every state has the duty to refra<strong>in</strong> from giv<strong>in</strong>g ass<strong>is</strong>tance<br />

to any state that <strong>is</strong> act<strong>in</strong>g <strong>in</strong> violation of Article 9, or aga<strong>in</strong>st the United Nations <strong>in</strong><br />

tak<strong>in</strong>g preventative measures or enforced action aga<strong>in</strong>st a state. Article 13 declares<br />

that every state has the duty to carry out <strong>in</strong> good faith its obligations ar<strong>is</strong><strong>in</strong>g from<br />

treaties and other sources of <strong>in</strong>ternational <strong>law</strong> and it may not <strong>in</strong>voke its prov<strong>is</strong>ions <strong>in</strong><br />

its constitution or its <strong>law</strong>s as an excuse for failure to perform th<strong>is</strong> duty. Th<strong>is</strong> particular<br />

article has been <strong>in</strong>tegrated <strong>in</strong>to Article 27 of the Vienna Convention on the Law of<br />
