prov<strong>is</strong>ions set out under the state of emergency can these rights be derogated from.<br />

The states are only limited by their agreements <strong>in</strong> <strong>in</strong>ternational <strong>law</strong> to other b<strong>in</strong>d<strong>in</strong>g<br />

contracts that may be <strong>in</strong> breach if they choose to carry out these derogations dur<strong>in</strong>g a<br />

time of emergency. Other state parties to similar treaties protect<strong>in</strong>g these rights can<br />

br<strong>in</strong>g the violations or breaches of these rights to the attention of the United Nations<br />

or the International Court of Justice. These breaches and/or derogations that conta<strong>in</strong><br />

both compliance with one Treaty and non-compliance with another come under the<br />

conflict of <strong>law</strong>s and would be decided on with<strong>in</strong> the court of the parties’ choos<strong>in</strong>g.<br />

It can be seen how rights of civilians that are protected <strong>in</strong> <strong>in</strong>ternational <strong>law</strong> as<br />

customary can also constitute derogations from the prov<strong>is</strong>ions of th<strong>is</strong> convention <strong>in</strong> a<br />

state of emergency. However the state must comply with<strong>in</strong> the strict application of the<br />

prov<strong>is</strong>ions from which they are derogat<strong>in</strong>g <strong>in</strong>clud<strong>in</strong>g all the steps that ensure the rights<br />

of the civilians are be<strong>in</strong>g protected. Th<strong>is</strong> <strong>in</strong>cludes firstly identify<strong>in</strong>g that a state of<br />

emergency ex<strong>is</strong>ts then send<strong>in</strong>g a letter to the Secretary-General and provid<strong>in</strong>g the<br />

articles from which they are derogat<strong>in</strong>g, why and at what date they stopped. If the<br />

state violates the prov<strong>is</strong>ions then the state <strong>is</strong> liable for attribution. On th<strong>is</strong> note there<br />

are several qualifications given by different courts and organ<strong>is</strong>ations on the<br />

application of state of emergency. These will be d<strong>is</strong>cussed <strong>in</strong> the next section before<br />

the analys<strong>is</strong> of actual state derogations under th<strong>is</strong> Covenant.<br />

CRITERIA FOR A STATE OF EMERGENCY/ FOR DEROGATIONS<br />

A situation that constitutes a state of emergency must be exam<strong>in</strong>ed. The United<br />

Nations Economic and Social Council provides def<strong>in</strong>itions with<strong>in</strong> the Siracusa<br />

Pr<strong>in</strong>ciples. 339 Derogations <strong>in</strong> a state of emergency must only be made when the state<br />

<strong>is</strong> faced with an imm<strong>in</strong>ent danger that threatens the life of the nation. Th<strong>is</strong> <strong>is</strong><br />

expla<strong>in</strong>ed as a situation that affects the whole of the population and part or whole of<br />

the territory of the state <strong>in</strong> question. Second, the situation must be classified as a<br />

threat to the physical <strong>in</strong>tegrity of the population, either the political <strong>in</strong>dependence or<br />

the territory itself. Th<strong>is</strong> may <strong>in</strong>clude the basic function<strong>in</strong>g of the state and its<br />
