Thirdly, Paragraph 138 of the 2005 World Summit outcome document states that the<br />

governments accept th<strong>is</strong> responsibility and will act <strong>in</strong> accordance with it. Th<strong>is</strong><br />

statement <strong>is</strong> not an added responsibility; it adds noth<strong>in</strong>g new to <strong>in</strong>ternational <strong>law</strong>. The<br />

state <strong>is</strong> already bound by their duties <strong>in</strong> <strong>in</strong>ternational <strong>law</strong> to prevent and protect their<br />

citizens from genocide and war crimes and therefore crimes aga<strong>in</strong>st humanity and<br />

ethnic cleans<strong>in</strong>g <strong>in</strong> <strong>in</strong>ternational <strong>law</strong>.<br />

Fourthly, the <strong>in</strong>ternational community should as appropriate, encourage and help<br />

states to exerc<strong>is</strong>e th<strong>is</strong> responsibility and support the United Nations <strong>in</strong> establ<strong>is</strong>h<strong>in</strong>g an<br />

early warn<strong>in</strong>g system. Other than br<strong>in</strong>g<strong>in</strong>g the violators of breaches of <strong>in</strong>ternational<br />

b<strong>in</strong>d<strong>in</strong>g treaties to the attention of the ICJ, the states themselves cannot <strong>in</strong>terfere <strong>in</strong><br />

the territorial <strong>in</strong>tegrity or <strong>in</strong>ternal affairs of another state. States must request help to<br />

receive help. Each state of the United Nations however has a duty to work with<strong>in</strong> the<br />

pr<strong>in</strong>ciples and purposes of the Charter <strong>in</strong> order to refra<strong>in</strong> from us<strong>in</strong>g force for the<br />

purpose of <strong>in</strong>ternational peace and security; they have the responsibility to support the<br />

United Nations and the Security Council <strong>in</strong> the ma<strong>in</strong>tenance of the peace. The<br />

United Nations’ <strong>in</strong>dividual organ<strong>is</strong>ations have separate responsibilities entailed <strong>in</strong><br />

their philosophies and constitutions that provide the framework for early warn<strong>in</strong>g<br />

systems. These systems are <strong>in</strong> place and the United Nations therefore has the<br />

responsibility to ensure that the <strong>in</strong>formation <strong>is</strong> provided to the states and the Security<br />

Council <strong>in</strong> a timely manner so that dec<strong>is</strong>ions can be made. In light of th<strong>is</strong> no<br />

additional responsibility can be added to the ex<strong>is</strong>t<strong>in</strong>g <strong>in</strong>ternational <strong>law</strong>s already <strong>in</strong><br />

place.<br />

Fifthly, paragraph 139 of the 2005 World Summit outcome document says the<br />

<strong>in</strong>ternational community, through the United Nations, also has the responsibility to<br />

use as appropriate diplomatic humanitarian and other peaceful means <strong>in</strong> accordance<br />

with Chapters VI and VIII of the Charter to help to protect populations from<br />

genocide, war crimes, ethnic cleans<strong>in</strong>g and crimes aga<strong>in</strong>st humanity, aga<strong>in</strong> re<strong>in</strong>forc<strong>in</strong>g<br />

already ex<strong>is</strong>t<strong>in</strong>g <strong>in</strong>ternational <strong>law</strong>s <strong>in</strong> the Charter.<br />

Sixthly, paragraph 139 of the 2005 World Summit outcome document states that<br />

each member of the United Nations <strong>is</strong> prepared to take collective action, <strong>in</strong> a timely<br />

and dec<strong>is</strong>ive manner, through the Security Council <strong>in</strong> accordance with the Charter,<br />

<strong>in</strong>clud<strong>in</strong>g Chapter VII, on a case-by-case bas<strong>is</strong> and <strong>in</strong> co-operation with relevant<br />
