THESIS APPLICATION<br />

Prior to the <strong>in</strong>tervention by the North Atlantic Treaty Organ<strong>is</strong>ation (NATO) with<br />

Security Council approval <strong>in</strong> Libya <strong>in</strong> 2011, there had been a tremendous amount of<br />

application <strong>in</strong>variance of the Responsibility to Protect (<strong>R2P</strong>) doctr<strong>in</strong>e (2005) by the<br />

United Nations Security Council and the United Nations member states. 1 Th<strong>is</strong><br />

<strong>in</strong>variance extended to the academic and political community. One apparent case of<br />

th<strong>is</strong> can be seen <strong>in</strong> the data collected from United Nations d<strong>is</strong>cussions on <strong>R2P</strong> post<br />

2005 and academic d<strong>is</strong>course post 2001 regard<strong>in</strong>g the International Comm<strong>is</strong>sion’s<br />

work on State Sovereignty and State Intervention. Th<strong>is</strong> d<strong>is</strong>course and observational<br />

or application <strong>in</strong>variance led the author to conduct research <strong>in</strong>to the legal application<br />

of the Responsibility to Protect (<strong>R2P</strong>) doctr<strong>in</strong>e from the 2005 World Summit outcome<br />

document, paragraphs 138 and 139.<br />

The research has been limited to the Rule of Law to human rights and humanitarian<br />

<strong>law</strong> as customary <strong>in</strong>ternational <strong>law</strong> to the application of the <strong>R2P</strong>. Th<strong>is</strong> also meant<br />

restrict<strong>in</strong>g the research by elim<strong>in</strong>at<strong>in</strong>g academic non-legal and political commentaries<br />
