(C) The Committee will meet with the Board<br />
of Governors and provide periodic written<br />
reports of its activities at least annually. The<br />
reports will contain program statistics, a<br />
description of program changes and<br />
developments, a narrative summary of results,<br />
suggestions for program changes, proposed<br />
amendments to applicable bylaws and policies,<br />
and such other general information as the Board<br />
of Governors may request. However, the identity<br />
of any person who has received assistance from<br />
the OAAP or the PMAP will not be requested or<br />
required to be disclosed, the periodic reports will<br />
not disclose the identity of any person who has<br />
received assistance from the OAAP or the PMAP,<br />
and in all cases the confdentiality of program<br />
participants will be maintained consistent with<br />
the provisions of ORS 9.568 and applicable <strong>Bar</strong><br />
and PLF policies.<br />
(D) For the purposes of ORS 9.568, all PLF<br />
employees as well as all other persons providing<br />
~ help through, at the request of, or with the<br />
approval of the OAAP and PMAP, will be deemed<br />
to be agents of the PLF-PPMAC (in addition to all<br />
others who fall within the definition of ORS<br />
9.568(5)).<br />

6.200 OREGON ATTORNEY ASSISTANCE<br />

The Professional Liability Fund has<br />
established an assistance program called the<br />
<strong>Oregon</strong> Attorney Assistance Program (OAAP).<br />
The purpose of the OAAP is to provide personal<br />
assistance to atteraey~lawvers and judges<br />
pursuant to ORS 9.568.<br />
(A)<br />
The purpose of the OAAP is:<br />

(1) To provide assistance to <strong>Oregon</strong><br />
lawyers and judges who experience al6~-"~<br />
d~ ~-',~-~:R:~problem alcohol, drue, and/or<br />
other substance use. burnout, career transition,<br />
depression, anxiety, compulsive disorders<br />
(including gambling addiction), time management<br />
issues, relationship issues, stress, or other<br />
distress that impairs a lawyer's or judge's ability<br />
to function:<br />
(2) To aid in the curtailment of<br />
malpractice claims and disciplinary complaints;<br />
(3) To educate the legal community<br />
about sources of distress and/or impairment.<br />

(B) The OAAP will be based on the concept<br />
of lawyers helping lawyers.<br />
(C) In order to assist <strong>Oregon</strong> lawyers and<br />
judges, the OAAP will be available to all <strong>Oregon</strong><br />
lawyers and judges. In addition, to the extent<br />
permitted by available resources, the OAAP will<br />
also be available to law office staff, court staff,<br />
families of lawyers and judges, and law students<br />
in <strong>Oregon</strong> law schools.<br />
(D) The OAAP will be conducted in the<br />
strictest basis of confidentiality. The OAAP<br />
program will use federel and state regulations<br />
on confidentiality of alcohol and chemical<br />
dependency programs as a basis for all OAAP<br />
guidelines and procedures. The confdentiality<br />
and privilege provided under ORS 9.080(2), ORS<br />
