RIGHT OF WAY<br />

KNOWN ALL MEN BY THESE PRESENTS, that I (we), owner(s) of the l<strong>and</strong><br />
hereinafter described, for <strong>and</strong> in consideration of payment of the sum of Five <strong>and</strong> no/100<br />
($5.00) Dollars to me in h<strong>and</strong> paid (the receipt whereof is hereby acknowledged) by<br />
<strong>Gr<strong>and</strong></strong> <strong>Str<strong>and</strong></strong> <strong>Water</strong> <strong>and</strong> <strong>Sewer</strong> <strong>Authority</strong>, I do hereby grant, bargain, sell <strong>and</strong> convey<br />
unto the said <strong>Gr<strong>and</strong></strong> <strong>Str<strong>and</strong></strong> <strong>Water</strong> <strong>and</strong> <strong>Sewer</strong> <strong>Authority</strong>, it successors <strong>and</strong> assigns, a rightof-way<br />
in, over <strong>and</strong> across the following described property, to wit:<br />
Documentary stamps are not required to be paid <strong>and</strong>/or affixed hereon by reason of<br />
Section 12-21-380, 1976 Code of Laws of South Carolina, as amended.<br />
The right-of-way herein granted includes, but is not necessarily limited to, the right <strong>and</strong><br />
privilege of the grantee, its successors <strong>and</strong> assigns, to construct, maintain, operate <strong>and</strong><br />
repair any <strong>and</strong> all useful, proper <strong>and</strong> necessary facilities <strong>and</strong> appurtenances for the<br />
purpose of conveying, pumping, <strong>and</strong> supplying residential, commercial, <strong>and</strong>/or industrial<br />
water <strong>and</strong>/or for the purpose of conveying, pumping, <strong>and</strong> transporting sanitary sewage<br />
<strong>and</strong> industrial waste waters <strong>and</strong> to make such relocations, changes, renewals,<br />
substitutions, replacements <strong>and</strong> additions of or to the same from time to time as the said<br />
grantee may deem desirable; the right at all times to cut <strong>and</strong> keep clear of said right-ofway<br />
any <strong>and</strong> all vegetation, trees, obstructions that might, in the opinion of the grantee,<br />
endanger or injure the said utility facilities or their appurtenances, or interfere with their<br />
proper operation or maintenance; the right of reasonable ingress <strong>and</strong> egress in, to, over<br />
<strong>and</strong> across the l<strong>and</strong>(s) of the grantor(s) referred to above for the purpose of exercising the<br />
rights <strong>and</strong> privileges herein granted; provided, nevertheless, that the failure of the grantee<br />
to exercise any of the rights or privileges herein granted shall not be construed as a<br />
waiver or ab<strong>and</strong>onment of any of the rights <strong>and</strong> privileges herein granted.<br />
The parties agree that the grantor(s) may l<strong>and</strong>scape, grow crops, maintain private<br />
driveways or private parking areas, <strong>and</strong> utilize the l<strong>and</strong>s above described for any other<br />
lawful purposes; provided, however, that crops shall not be planted over any utility lines<br />
where the top of said lines are less than eighteen (18) inches under the surface of the<br />
ground <strong>and</strong> that the use of said l<strong>and</strong> by the grantor(s) shall not, in the opinion of the<br />
grantee, interfere or conflict in any manner with the use of said l<strong>and</strong> by the grantee for the<br />
purposes hereinabove mentioned, <strong>and</strong> that no use of said l<strong>and</strong> shall be made by the<br />
grantor(s) as would, in the opinion of the grantee, injure, endanger or render inaccessible<br />
the water <strong>and</strong>/or sewer utilities or their appurtenances. No building or structure shall be<br />
erected by the grantor(s) on the right-of-way herein granted; nor so close thereto as to<br />
impose any load or stress thereon. The grantor(s) covenant <strong>and</strong> agree that in the event<br />
