Address for formal delivery of any notice will be as follows: Name Mailing Address City, State, Zip Code Grand Strand Water and Sewer Authority P.O. Box 2368 Conway, SC 29528-2368 Developer or his assignee will notify the Authority in writing of any address change. If occasioned by Developer negligence and to the extent permitted by South Carolina State Law, Developer agrees to indemnify, defend, hold harmless and reimburse the Authority, its authorized agents or employees, from and against any and all losses, liabilities, expenses and claims for damages, direct or indirect of any third party for or arising out of the installation, maintenance, presence, removal or destruction of the decorative fence, under the terms of this Agreement. The Authority grants Developer reasonable and timely access to install, maintain or remove the decorative fence. Should the Developer fail to install the fence within ninety (90) days of the execution of this Agreement, the Agreement will be null and void. Unless voided by conditions contained herein, the terms of this Agreement are valid for a period of ten (10) years from this date and may be renewed thereafter by agreement of both parties. In the event this Agreement is not renewed upon its termination in ten (10) years, all rights, duties and obligations under this Agreement terminate. This Agreement may not be transferred or assigned to any other party without prior written consent of both parties. The Authority agrees, however, that Developer may transfer rights, duties and obligations in this Agreement to Appendices July 2009 Grand Strand Water and Sewer Authority Page 84 Developer Policy Manual
. The Developer will give the Authority written notice when any such transfer will occur and provide a formal delivery address for the transferee.
