Judicial Selection, Task Force on<br />
Recommendations on the Selection of Judges and the Improvement of<br />
the Judicial Selection System in <strong>New</strong> <strong>York</strong> State. The report reiterates the<br />
<strong>City</strong> <strong>Bar</strong>’s long-standing position in favor of a commission-based appointive<br />
system and sets forth a proposed amendment to Article 6 of the <strong>New</strong> <strong>York</strong><br />
State Constitution to implement such a system. However, the report recognizes<br />
that a change to an appointive system could be complex and<br />
lengthy. So in the alternative the report recommends statutory reform of<br />
the current judicial convention system to redress the constitutional infirmities<br />
identified in Lopez Torres until the State Constitution is amended<br />
in favor of a commission-based appointive system. The report opposes<br />
the default solution of primary elections for Supreme Court, and also<br />
offers suggested changes that can be made to promote a more diverse pool<br />
of judicial candidates.<br />
Labor and Employment Law<br />
“Employment Law Handbook for Non-Lawyers.” The handbook is designed<br />
to assist individuals who have legal questions about their rights in the<br />
workplace. It provides a brief introduction and addresses a number of questions<br />
and issues for those who feel they have a workplace problem that they<br />
can not resolve and believe they require outside intervention to solve.<br />
Lawyers Assistance Program/Professional Discipline<br />
A Proposal for Adoption of a Diversion Rule for Lesser Misconduct Related<br />
to Alcohol/Substance Abuse or Mental Health Condition. The report recommends<br />
that the Appellate Division, First Department, establish a diversionary<br />
program for lawyers suffering from alcohol or substance abuse or<br />
a mental health condition, and proposes a draft rule along with commentary.<br />
Offering diversion, treatment and monitoring for lesser misconduct<br />
related to a mental health condition or alcohol or substance abuse,<br />
the report argues, is consistent with the best interests of the profession<br />
and the public and is already in place in other jurisdictions.<br />
Legal <strong>Issue</strong>s Pertaining to Animals<br />
Memorandum supporting <strong>New</strong> <strong>York</strong> <strong>City</strong> Council Resolution 497 which<br />
calls upon the <strong>New</strong> <strong>York</strong> <strong>City</strong> Department of Education to help increase<br />
compliance with Section 809 of the <strong>New</strong> <strong>York</strong> State Education Law. Section<br />
809 requires instruction in <strong>New</strong> <strong>York</strong> <strong>City</strong> and State schools on the<br />
humane treatment and protection of animals.<br />
